Piekļuves nodrošināšana nekustamajam īpašumam ir viens no būtiskākajiem priekšnosacījumiem, lai nekustamā īpašuma īpašnieks varētu realizēt tiesību valdīt un lietot sev piederošo īpašumu. Lai arī tiesiskais regulējums paredz to risināt, praksē bieži sastopamas ir situācijas, kad nav zemes gabaliem nodrošināta piekļuve un par piekļuves nodrošināšanu jālemj tiesai. Maģistra darba mērķis ir analizēt ar jēdziena “piekļuves nodrošināšana nekustamajam īpašumam” saistīto problemātiku, tā vēsturisko izcelsmi, pašvaldību dažādo izpratni par zemes gabalu veidošanas juridiskajiem nosacījumiem un to, kādi situācijas risinājumi šobrīd ir pieejami tiesiskajā regulējumā. Darbā ir iegūti secinājumi par pašvaldības sniegtajiem viedokļiem un par tiesiskā regulējuma risinājumu efektivitāti, nepilnībām, trūkumiem un iespējām to uzlabot. The objective of this master's thesis is to explore the legal issues surrounding access provision to real estate in the context of land use and ownership. The author aims to analyze the historical origins of this concept and examine the legal conditions that municipalities use to create plots of land. The thesis will also investigate the various legal solutions available to address situations where there is no access to land parcels, and the courts must intervene. Through the analysis, the author will draw conclusions on the effectiveness of each legal regulation, identifying any shortcomings or deficiencies that need improvement. This research will be based on a comprehensive review of the relevant legal literature and case law related to access provision to real estate. The author will also examine the Land Management Law and land improvement projects and discuss the role of easements in resolving access disputes.
