Brīvības atņemšanas soda izpildes īpatnības grūtniecēm un sievietēm ar bērniem

Abstract

Brīvības atņemšanas soda izpilde grūtniecēm un sievietēm ar bērniem ir aktuāls un sarežģīts jautājums, jo notiesātās sievietes bērnam ir jāuzturas ieslodzījuma vietā vai viņš tiek šķirts no mātes, kas bieži ir primārā bērna aprūpētāja. Bakalaura darba mērķis ir brīvības atņemšanas soda izpildes īpatnību grūtniecēm un sievietēm ar bērniem izpēte un priekšlikumu Latvijas normatīvā regulējuma pilnveidošanai izstrādāšana. Galvenie uzdevumi ir izpētīt ieslodzījuma vietu sievietēm vēsturi, analizēt doktrīnu, tiesu praksi un starptautiskus dokumentus, aplūkot Latvijas un ārvalstu regulējumus. Rezultātā tiek uzskaitītas grūtnieču un sieviešu ar bērniem īpatnības brīvības atņemšanas soda izpildē, iezīmēti tām nodrošināmie apstākļi. Tiek analizēti Latvijas un ārvalstu normatīvie regulējumi un izvirzīti priekšlikumi Latvijas regulējuma pilnveidošanai.

The execution of a custodial sentence for pregnant women and women with children is a topical and complex issue, because the convicted woman’s child has to live in prison or be separated from their mother, who is often the child’s primary caregiver. The aim of the bachelor’s thesis is to study specific features of the execution of a custodial sentence for pregnant women and women with children and develop proposals for improving the Latvian regulatory framework. The main tasks are to study the history of women’s prisons, to analyse doctrine, judicial practice, international documents and to examine Latvian and foreign regulatory frameworks. As a result, specific features of the execution of a custodial sentence for pregnant women and women with children are listed and the conditions to be provided for them are outlined. Latvian and foreign regulatory frameworks are analysed and proposals for improving Latvian framework are put forward.
