Apvienoto Nāciju Organizācijas 1980.gada 11.aprīļa Konvencija par starptautiskajiem preču pirkuma-pārdevuma līgumiem (turpmāk – Konvencija), kuru ratificējušas divas trešdaļas pasaules ekonomiku veidojošās valstis, piemērojama lielākajai daļai starptautisko preču pirkuma-pārveduma līgumiem. Neskatoties uz Konvencijas popularitāti un to, ka Konvencija ir uzskatāma par lielāko un veiksmīgāko dokumentu starptautiskās tirdzniecības tiesībās, Latvijas tiesību zinātnē tā pētīta salīdzinoši maz. Šī darba temats, proti, informēšanas pienākums kā sadarbības pienākuma elements Konvencijas 80.pantā, nav atsevišķi pētīts arī ārzemju doktrīnā. Vienas puses informēšanas pienākuma neizpilde kā iemesls otras puses atbrīvošanai no atbildības par līguma saistības neizpildi ir daudzslāņains jautājums, kas savā pamatā ietver tiesību piemērotāja attieksmi pret Konvencijā ietvertā godprātības principa interpretāciju un tvērumu. Tādējādi, lai nonāktu pie risinājuma par iepriekš minēto darba fokusa problēmjautājumu, darbā sākotnēji noskaidrotas Konvencijas interpretācijas metodes, Konvencijā ietvertā godprātības principa saturs un tvērums, un secināts, ka godprātības princips ir ne tikai strikts Konvencijas interpretācijas princips, bet arī princips, no kā atvasināmas pušu tiesības un pienākumi. Secīgi aplūkots no godprātības principa izrietošais sadarbības pienākums, un no tā izrietošais informēšanas pienākums pēc būtības, kā arī Konvencijas 80.panta piemērošanas kritēriji, saprātīguma standarta saturs un cēloņsakarības noteikšanas paņēmieni. The United Nations Convention on Contracts for the International Sale of Goods, dated April 11, 1980 (hereinafter referred to as the Convention), has been ratified by two-thirds of the world's economic powers and applies to the majority of international sales contracts for goods. Despite its popularity and status as the largest and most successful document in international trade law, it has been relatively under-researched in Latvian legal scholarship. The topic of this work, specifically the duty to inform as an element of the duty to cooperate under Article 80 of the Convention, has also not been separately studied in foreign doctrine. The failure of one party to fulfil its duty to inform, which serves as a reason for the other party's exemption from liability for non-performance of contract obligations, is a multi-layered issue. It fundamentally involves the legal practitioner's approach to the interpretation and scope of the principle of good faith, included in the Convention. Therefore, to address the aforementioned focus problem of this work, it initially clarifies the methods of interpretation of the Convention, the content and scope of the principle of good faith included in the Convention and concludes that the principle of good faith is not only a strict principle of interpretation but also a principle from which the rights and obligations of the parties can be derived. Subsequently, it examines the duty to cooperate arising from the principle of good faith and, in essence, the duty to inform, as well as the criteria for applying Article 80 of the Convention, the content of the reasonableness standard, and the methods for determining causality.
