Latvijas augstskolu studējošo pašpārvalžu juridisko formu problemātika

Abstract

Bakalaura darbā “Latvijas augstskolu studējošo pašpārvalžu juridisko formu problemātika” tiek aplūkota augstskolas studējošo pašpārvalde kā neordinārs veidojums, kura tiesiskā eksistence un multiplās juridiskās personības mēdz radīt neizpratni vairākos līmeņos – sākot ar normatīvā regulējuma izstrādi un beidzot ar tā piemērošanu praksē. Darba autors, analizējot studējošo pašpārvaldes darbību gan augstskolas iekšējās institucionālās struktūras ietvaros, gan juridiskās personas statusā, kā arī pievēršot uzmanību konkrētiem pašpārvaldes darbības aspektiem, secina, ka tā ir saistīta ar daudzveidīgām problēmām, kuras ir jārisina holistiski – grozot ārējos un iekšējos normatīvos aktus un pašām studējošo pašpārvaldēm mainot savas darbības principus, lai tiktu ievērotas tiesību normas.

The bachelor’s thesis “Problems regarding the legal forms of student self-governance bodies of Latvian universities” analyzes the student self-governance body of a higher education institution as an extraordinary body whose legal existence and multiple legal personalities cause confusion in the creation of a regulatory framework, as well as in its application in practice. The author analyzes the functioning of a student self-governance body within the internal institutional structure of a higher education institution and while acting as a legal person, and pays attention to specific aspects of a self-governance body’s activities, identifying diverse challenges that ought to be addressed holistically – by amending laws and internal regulations and by changing the practices of student self-governance bodies to ensure legal compliance.
