Satversmes tiesas kompetence vērtēt nacionālo tiesību atbilstību Eiropas Savienības sekundārajiem tiesību aktiem

Abstract

Bakalaura darbā “Satversmes tiesas kompetence vērtēt nacionālo tiesību atbilstību Eiropas Savienības sekundārajiem tiesību aktiem” tiek pētīta Satversmes tiesas pastāvošā prakse un tiek analizēts Satversmes tiesas kompetences normatīvā regulējuma tvērums. Līdz šim Satversmes tiesa savā praksē izvairās sniegt konkrētu atbildi par tās kompetenci vērtēt nacionālo tiesību normu atbilstību Eiropas Savienības sekundārajiem aktiem. Darba mērķis ir izpētīt esošā normatīvā regulējuma tvērumu, Satversmes tiesas praksi un nostāju par tās kompetenci attiecībā uz Eiropas Savienības sekundārajiem tiesību aktiem un piedāvāt iespējamos uzlabojums pastāvošajā praksē. Jautājums līdz šim akadēmiskajā vidē pētīts daļēji.

In the bachelor thesis "Constitutional Court of Latvia competence to evaluate national law compliance with European Union’s secondary law" is studied the existing practice of the Constitutional Court of Latvia and the scope of the normative regulation of the competence of the Constitutional Court of Latvia. So far, in its practice, the Constitutional Court has avoided giving a concrete answer on its competence to evaluate national law compliance with European Union’s secondary law. The aim of this paper is to examine the scope of the existing normative regulation, the practice, and the position of the Constitutional Court of Latvia on its competence to evaluate national law compliance with European Union’s secondary law and explore possible improvements for the existing practice. So far, the issue has been partially studied in the academic environment.
