Dalītās atbildības izpratne ANO Konvencijas par starptautisko preču pirkuma-pārdevuma līgumiem 80. pantā

Starptautiskās tirdzniecības tiesību doktrīnā vēl aizvien nav viennozīmīgas atbildes par to, vai CISG 80. pants ir piemērojams situācijām, kur abas puses ir izraisījušas vienas puses līguma neizpildi jeb dalītās atbildības (shared responsibility) gadījumiem. Bakalaura darba mērķis ir izpētīt dalītās atbildības izpratni doktrīnā un ārvalstu tiesu un šķīrējtiesu praksē. Darba ietvaros tiks analizēti doktrīnā pastāvošie atšķirīgie viedokļi par CISG 80. panta piemērošanu dalītās atbildības gadījumiem, raksturojot atšķirīgo viedokļu ieguvumus un problemātiku. In the doctrine of international trade law, it is still a subject of debate and there is still no definitive answer as to whether Article 80 of the CISG is applicable to situations where both parties have contributed to causing one party’s non-performance of the contract, i.e. cases of shared responsibility. The thesis aims to explore the understanding of shared responsibility in doctrine and in the practice of foreign courts and international arbitration. Within the thesis, the existing different opinions regarding the application of Article 80 of the CISG in cases of shared responsibility will be analysed, outlining the advantages and issues of these differing perspectives.
