Maģistra darbā aplūkots patērētāju kolektīvo prasību celšanas mehānisms Latvijā, kas 2023. gada 14. septembrī ieviests Civilprocesa likumā un Patērētāju tiesību aizsardzības likumā, transponējot Eiropas Parlamenta un Padomes Direktīvu (ES) 2020/1828 (2020. gada 25. novembris) par pārstāvības prasībām patērētāju kolektīvo interešu aizsardzībai un ar ko atceļ Direktīvu 2009/22/EK. Darba mērķis ir analizēt patērētāju kolektīvo prasību celšanas mehānismu Latvijā. Darba uzdevumi ir aplūkot kvalificēto iestāžu statusu, tiesības un pienākumus, analizēt pamatu un sagatavošanos patērētāju kolektīvo prasību celšanai un tās regulējumu, citstarp salīdzinot Latvijā pieņemto regulējumu ar citu ES dalībvalstu regulējumu. Darba rezultātā izvirzīti secinājumi par regulējuma nepilnībām un piedāvāti priekšlikumi tā uzlabošanai. The master’s thesis reviews the mechanism for bringing consumer collective claims in Latvia, which was introduced on 14 September 2023 in the Law on Civil Procedure and the Law on the Protection of Consumer Rights, transposing Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on representative actions for the protection of the collective interests of consumers and repealing Directive 2009/22/EC. The aim of the work is to analyse the mechanism of raising consumer collective claims in Latvia. The tasks of the work are to examine the status, rights, and obligations of qualified institutions, to analyse the preparation and basis for raising consumer collective claims and its regulations, comparing the regulation adopted in Latvia with other EU member states. As a result of the work, conclusions are drawn about the shortcomings of the regulation and proposals for its improvement are proposed.
