Fiktīvo laulību juridiskie aspekti

Abstract

Bakalaura darba temats ir: Laulības ar ārvalstnieku – tiesiskais regulējums. Darba mērķis - pamatojoties uz vispārējiem tiesību principiem, nacionālajām tiesību normām Eiropas Savienības tiesību kontekstā, kā arī uz tiesu praksi un literatūras avotu atziņām par laulībām ar ārvalstnieku - izzināt jautājumu par fiktīvajām laulībām starp personām, kuri ir dažādu valstu pilsoņi. Galvenie problēmjautājumi, uz kuriem jāatbild, lai sasniegtu darba mērķi ir ietverti četrās apakšnodaļās: 1.Laulības institūts Latvijā. 2.Laulības ar ārvalstnieku. 3.Fiktīvo laulību aspekti un risināšanas iespējas. 4. Beļģijas Karalistes laulību institūts salīdzinoši ar Latvijas Republiku: kopīgais un atšķirīgais.

Pēc darba iegūtajiem rezultātiem tiek izteiktas nākotnes perspektīvas, kas varētu uzlabot gan laulību noslēgšanu, gan apkarot fiktīvās laulības. Viens no galvenajiem ieteikums un secinājumiem autora skatījumā ir Eiropas Parlamenta un Padomes Direktīvas 2004 /38 /EK grozījumu nepieciešamība, fiktīvo laulību un nelegālās imigrācijas apkarošanai. Nosakot efektīvu, regulāru ārzemnieku kontroli, neaizkarot cilvēka cieņu un godu, kā arī maksimāli neiejaucoties privātajā dzīvē gan no laulību pieteikuma brīža līdz laulībām, gan regulāra ģimenes apsekošana un izvērtēšana vai personas atbilst laulību būtībai līdz brīdim, kad personas saņem patstāvīgās uzturēšanās atļauju ir viens no veidiem kā mazināt fiktīvo laulību esamību. Fiktīvo laulību jautājums ir ļoti svarīgs tiesiskā valstī, laikā kad noteikta brīvu personu kustība. The theme of bachelor paper is Marriage with foreigner – legal regulation. The objective of the paper – investigate the issue of the property relations between spouses of different citizenship in cases of dissolution of marriage or the declaration of a marriage as fictitious and examine question of entering into marriage with foreigner, basing on general legal principles, national legal norms within the context EU legislation and legal practice and publications regarding marriage with foreigner.

Main questions to be resolved to meet the aim of the paper are included in four chapters: 1.Marriage institution in Latvia. 2.Marriage with foreigner. 3.The aspects of fictitious marriage and possible solutions. 4.Comparison of marriage institution between the Kingdom of Belgium and the Republic of Latvia.

Basing on the results of the research the future perspectives to improve the marriage and combat fictitious marriages are marked.

One of the main issues as noted by author is to amend European Parliament and Council Directive No 2004 /38 /EK to improve combating of fictitious marriages and illegal immigration. One of the ways to decrease number of fictitious marriages is settlement of regular control over foreigners, not offending the dignity and respect and not interfering the private living from application of marriage till marriage, and regular inspection and assessment of families to ensure that spouses correspond the essence of marriage until receiving of permanent residence permit. The issue of fictitious marriages is very important in lawful country where free flow of persons is allowed.
