Bakalaura darba mērķis ir noteikt, vai Krimināllikumā paredzētais fiziskas personas kā juridiskas personas pārstāvja atbildības regulējums ir taisnīgs, kā arī noteikt šī regulējuma nepilnības un piedāvāt šo nepilnību iespējamu risinājumu.
Lai īstenotu bakalaura darba mērķi, darbā ir apskatīts pašreizējais fiziskas personas kā juridiskas personas pārstāvja regulējums Krimināllikumā, kā arī šī regulējuma cēloņi un vēsturiskā attīstība. Tāpat darbā izvērtēts ārvalstu regulējums šajā jautājumā, kā arī latviešu un ārvalstu tiesību zinātnieku viedokļi par fiziskas personas kā juridiskas personas pārstāvja atbildību un fizisko personu veikto darbību saistību ar juridisko personu.
Bakalaura darbā apskatīts fiziskas personas kā juridiskas personas kriminālatbildības regulējums Krimināllikuma Vispārīgajā daļā, tās saistība ar juridiskajām personām piemērojamajiem piespiedu ietekmēšanas līdzekļiem kā arī juridiskās personas darbinieku atbildības regulējums Krimināllikuma Sevišķajā daļā, ciktāl tas attiecas uz atbildīga darbinieka institūtu Krimināllikumā.
Darba autors norāda uz nepilnībām pašreizējā Krimināllikuma regulējumā attiecībā uz juridiskas personas interešu saistību ar fiziskās personas darbībām un ierosina veikt grozījumus Krimināllikuma 70.1 pantā, lai nodrošinātu, ka Krimināllikuma regulējumā ir pareizi noteikta fiziskas personas darbību saistība ar juridisko personu. The aim of the bachelor thesis is to determine whether the current regulation of the criminal responsibility of an individual as a representative of a legal entity in the Criminal Law of Latvia is equitable, and to also determine the faults of this regulation and their possible solutions.
To implement the aim of the bachelor thesis, the current regulation in Criminal Law of the criminal responsibility of an individual as a representative of a legal entity is examined, as well as the causes and historical development of this regulation. Also the regulation of other nations is evaluated, as well as the opinions of both Latvian and foreign legal scholars on this matter and the connection between the actions of an individual and the corresponding legal entity.
In the bachelor thesis the author examines the regulation of the responibility of an individual as a representative of a legal entity as it is regulated in the General Section of the Criminal Law, its connection with the compulsory measures applicable to legal entities as well as the regulation of an individual’s responsibility in the Special Section of the Criminal Law, as far as it concerns the institute of a responsible employee in Criminal Law.
The author of the thesis points out faults in the current regulation of the Criminal Law and suggests possible amendments in Article 701 of the Criminal Law, to ensure that the connection between the actions of an individual and the interests of a legal entity is correctly established.
