Surogasijas ietekme uz bērna tiesību un interešu aizsardzību

Abstract

Darbā pētīts surogasijas jēdziens un veidi, tās ētiskie aspekti, tās starptautiskais un nacionālais regulējums, bērna vislabāko interešu principa tiesiskais saturs un kā tā ievērošana korelē ar bērna dzimšanu surogasijas ceļā. Darba mērķis bija izanalizēt, kādu ietekmi uz surogasijā radīto bērnu tiesību aizsardzību atstāj šie procesi un vai tie atbilst bērna vislabākajām interesēm. Darbā secināts, ka mūsdienu sabiedrībā surogasijas procesi var atstāt negatīvu ietekmi uz bērna tiesību aizsardzību, it sevišķi uz bērna tiesībām uz identitāti, kas ir fundamentāla bērna tiesība – tā ir visu citu tiesību pamatā. Negatīvā ietekme var rasties divu iemeslu dēļ: valstij un surogasijā iesaistītajām pusēm nepieņemot radušās bioloģiskās un ģimeniskās attiecības; un surogasijas vienošanos nesaistošā rakstura dēļ. Bērna vislabāko interešu princips pieprasa, lai bērna intereses būtu ņemtas vērā arī surogasijas jautājumos, bet tas ne vienmēr tiek darīts. Tā kā surogasija ir mūsdienu realitāte, gan starptautiski, gan nacionāli surogasija būtu jāregulē un vēlams jālegalizē, lai varētu kontrolēt, ka bērna vislabākās intereses tiek ievērotas.

This study explores the concept and types of surrogacy, its ethical dimensions, its international and national regulatory frameworks, the legal content of the principle of the best interests of the child, and the extent to which compliance with this principle aligns with the circumstances of a child's birth through surrogacy. The objective of this research was to examine the impact of such arrangements on the protection of the rights of children born through surrogacy, and to assess whether these processes align with the principle of the best interests of the child. It was concluded that, in contemporary society, surrogacy practices may exert an adverse influence on the protection of children's rights, particularly on the child's right to identity — a fundamental right which underpins the realisation of all other rights. The adverse impact may arise from two primary factors: the refusal of the state and the parties involved in surrogacy to acknowledge the resulting biological and familial relationships; and the non-binding nature of surrogacy agreements. The principle of the best interests of the child necessitates that the child's interests be duly prioritised in matters concerning surrogacy; however, this requirement is not consistently upheld in practice. Given that surrogacy constitutes an established reality both nationally and internationally, it is imperative that it be subject to appropriate regulation and, preferably, legalisation, in order to ensure effective protection of the child's best interests.
