Adopcijas noslēpuma problemātiskie aspekti

Adopcijas noslēpums rada kolīziju starp bērna tiesībām uz identitāti un vecāku tiesībām uz privāto dzīvi. Darba mērķis ir noskaidrot šo tiesību mijiedarbību un panākt lielāku adoptētā tiesību aizsardzību. Pētījuma rezultātā tiek secināts, ka spēkā esošais regulējums vairāk aizsargā tieši adoptētāja tiesības uz privāto dzīvi, tādēļ, lai nodrošinātu adoptētā tiesības uz identitāti, tiek piedāvāti grozījumi Civillikuma 171.panta trešajā daļā, Civilstāvokļa aktu reģistrācijas likuma 6.panta sestajā daļā un Bāriņtiesu likuma 34.panta trešajā daļā. Tiek piedāvāts papildināt Ministru kabineta noteikumu Nr. 667 “Adopcijas kārtība” 33.punktu, Civillikuma 171.pantu ar ceturto daļu, kā arī ieviest jaunu tiesību normu Krimināllikumā. Adoption secrecy creates a conflict between the child's right to identity and the adoptive parents' right to private life. The aim of this work is to explore the interaction of these rights and to achieve greater protection of the adoptee's rights. The research concludes that the current legal framework primarily protects the adoptive parents’ right to privacy. Therefore, to ensure the adoptee’s right to identity, amendments are proposed to Article 171, Part Three of the Civil Law; Article 6, Part Six of the Law on Registration of Civil Status Acts; and Article 34, Part Three of the Law on Orphan’s and Custody Courts. It is proposed to supplement Paragraph 33 of the Cabinet Regulation No. 667 “Procedures for Adoption”; Article 171 of the Civil Law with a fourth part, as well as to introduce a new legal norm in the Criminal Law.
