Dzīvokļu īpašnieku kopība civilprocesā

Abstract

Bakalaura darba temats ir “Dzīvokļu īpašnieku kopība civilprocesā”. Dzīvokļu īpašnieku kopība kā pastāvīgs tiesību subjekts, Latvijas tiesību sistēmā ir radusies salīdzinoši nesen. Darba mērķis ir analizēt dzīvokļu īpašnieku kopības kā tiesību subjekta tiesisko regulējumu un aktuālos problēmjautājumus saistībā ar kopības dalību civilprocesā, un sniegt priekšlikumus par šo jautājumu pilnveidi. Lai sasniegtu noteikto mērķi, autore izpētīja dzīvokļu īpašnieku kopības tiesisko regulējumu Latvijā un ārvalstīs, kopības tiesībspējas un rīcībspējas pamatus civilprocesā, analizēja kopības spēju būt par lietas dalībnieku tiesvedībās un kopības pārstāvību civilprocesā, un izpētīja kopības pieņemto lēmumu pārsūdzības procesu civilprocesa kārtībā. Veicot tiesību normu un tiesu prakses analīzi, autore darba izstrādes rezultātā izdarīja secinājumus un saskatīja tiesību normu nepilnības, kopsavilkumā sniedzot savus priekšlikumus tiesību normu pilnveidei. The topic of the bachelor thesis is “The Community of Apartment Owners in Civil Procedure”. The community of apartment owners, as a permanent legal subject, has emerged relatively recently in the Latvian legal system. The aim of the thesis is to analyze the legal regulation of the community of apartment owners as a legal subject and current legal issues related to the community's participation in civil procedure, and to provide suggestions for the improvement of these issues. To achieve the stated aim, the author studied the legal regulation of the community of apartment owners in Latvia and abroad, the foundations of the community's legal capacity and capacity to act in civil procedure, analyzed the ability of the community to be a party to the case in legal proceedings and the representation of the community in civil procedure, and studied the appeal process of decisions taken by the community in civil procedure. By analyzing legal norms and case law, the author drew conclusions as a result of the development of the thesis and identified shortcomings in legal norms, providing her suggestions for the improvement of legal norms in the summary.
