Bāzes līniju iesaldēšanas atbilstība starptautiskajām jūras tiesību normām

Abstract

Bakalaura darbā tiek pētīta bāzes līniju iesaldēšanas iespējamība jūras līmeņa celšanās kontekstā, kas apdraud zemo piekrastes valstu teritorijas un jūras zonas. Darba mērķis ir noskaidrot, vai starptautiskais regulējums pieļauj bāzes līniju iesaldēšanu. Darba ietvarā tiek analizētas Apvienoto Nāciju Organizācijas Jūras tiesību konvencijas normas un iespējama jaunas paražu tiesības kristalizācija. Darba uzdevumi ir Apvienoto Nāciju Organizācijas Jūras tiesību konvencijas interpretācija un valstu prakses izvērtējums. Darba rezultāti liecina, ka Konvencijas teksta interpretācija lex lata bāzes līniju iesaldēšanu nepieļauj. Tomēr, ņemot vērā līguma piemērošanas praksi, interpretācija var atbalstīt bāzes līniju iesaldēšanas iespējamību. Jauna paražu tiesības norma par bāzes līniju iesaldēšanu pagaidām nav kristalizējusies.

The bachelor thesis examines the potential for baseline freezing in the context of sea level rise, which threatens the land and maritime zones of low-lying coastal states. It aims to clarify whether international regulation allows for freezing of baselines. Within the scope of the thesis, norms in the United Nations Convention on the Law of the Sea and the possible crystallisation of a new customary law are analysed. Objectives are the interpretation of the United Nations Convention on the Law of the Sea and the assessment of state practice. The findings show that lex lata interpretation of the text of the Convention does not allow freezing of baselines. However, in light of subsequent practice, the interpretation may support the possibility of freezing baselines. A new customary law rule on freezing baselines has not yet crystallised.
