Eiropas Parlamenta un Padomes Direktīvu (ES) 2015/849, 2018/843 un 2024/1640 ietekme uz Latvijas nacionālo regulējumu

Abstract

Bakalaura darbā tiek pētīta Direktīvu (ES) 2015/849, 2018/843 un 2024/1640 ieviešana Latvijas nacionālajā regulējumā, kā arī izaicinājumi naudas atmazgāšanas un terorisma finansēšanas novēršanas jomā. Pētījuma mērķis ir izvērtēt, cik pilnvērtīgi Latvija transponējusi minētās direktīvas, identificējot likumdošanas un prakses izaicinājumus un ierosinot nepieciešamos uzlabojumus. Uzdevumi ietver ES direktīvu analīzi, to salīdzinājumu ar Latvijas normatīvajiem aktiem, identificēto noziedzīgi iegūtu līdzekļu un terorisma finansēšanas joma pārkāpumu un izaicinājumu izvērtēšanu un citu ES valstu prakses analīzi. Veicot pētījumu, autore nonākusi pie secinājumiem par direktīvu ieviešanas problemātiku, termiņa trūkumiem un dažādiem izaicinājumiem praksē, kas caur argumentētu analīzi novedis pie iespējamiem risinājumiem.

The Bachelor's Thesis studies the implementation of Directives (EU) 2015/849, 2018/843 and 2024/1640 in the national regulation of Latvia, as well as challenges in the field of preventing money laundering and terrorist financing. The aim of the study is to assess how fully Latvia has transposed the directives, identifying legislative and practical challenges and proposing necessary improvements. The tasks include an analysis of EU directives, their comparison with Latvian regulatory enactments, an assessment of identified violations and challenges in the field of criminal proceeds and terrorist financing, and an analysis of the practice of other EU countries. While conducting the study, the author has come to conclusions about the problems of implementing the directives, shortcomings in the deadline and various challenges in practice, which through an argumentative analysis has led to possible solutions.
