Pašvaldību referendumi

Abstract

Bakalaura darbā tiek izzināts pašvaldību referendumu tiesiskais regulējums Latvijā, analizējot 2024. gadā spēkā stājušos Vietējo pašvaldību referendumu likumu, kurš pašvaldību iedzīvotājiem ir sniedzis tukšas, praksē nerealizējamas tiesības. Līdz ar to šī darba galvenais mērķis ir izvirzīt priekšlikumus pašreizējā pašvaldību referendumu regulējuma pilnveidei, lai Latvijā, pašvaldības iedzīvotāju tiesības iesaistīties tai svarīgu jautājumu iniciēšanā un pieņemšanā referendumu ceļā nebūtu tikai formālas. Darba gaitā konstatēts, ka Vietējo pašvaldību referendumu likumā daudzviet ir pārņemts jau praksē pārbaudītais, pilsoņu kopuma tiesību realizāciju apgrūtinošais nacionālā līmeņa referendumu regulējums, kas ļauj izdarīt pieņēmumu, ka pašvaldību referendumi Latvijā būs tik pat neveiksmīgi kā nacionāla mēroga referendumi.

The bachelor's thesis explores the legal framework of municipal referendums in Latvia, analysing the Local Government Referendum Law, which came into force in 2024 and has granted residents of municipality’s rights that are essentially empty and unimplementable in practice. Therefore, the main objective of this thesis is to propose improvements to the current regulation of municipal referendums, so that the rights of municipal residents in Latvia to participate in initiating and deciding on important issues through referendums are not merely formal. During the course of the research, it was found that the Local Government Referendum Law has, in many instances, adopted the already-tested and restrictive regulation of national referendums, which complicates the exercise of citizen’s collective rights. This leads to the assumption that municipal referendums in Latvia may be just as unsuccessful as national referendums.
