Pilsonības atņemšana

Abstract

Pilsonībai ir svarīga loma personu dzīvēs, taču to valsts var arī atņemt. Ne tikai Latvija, bet arī citas valsts izvēlās papildināt pilsonības likumus ar pilsonības atņemšanas pamatiem. Bakalaura darba mērķis ir izpētīt Latvijas Pilsonības likumā ietvertos pilsonības atņemšanas pamatus un salīdzināt tos ar ārvalstu tiesisko regulējumu. Lai sasniegtu šo mērķi, darbā tiek pētīts pilsonības jēdziens, pilsonības institūta attīstība, pieci no pašlaik Pilsonības likumā ietvertajiem pilsonības atņemšanas gadījumiem, kā arī starptautisko tiesību regulējums saistībā ar bezvalstniecības samazināšanu. Darba rezultātā ir konstatēts, ka pilsonības atņemšana joprojām ir nozīmīgs mehānisms, lai nodrošinātu tādu pilsoņu kopumu, kas nerada draudus un ir lojāli valstij.

Citizenship plays an important role in the lives of individuals, but one can also be deprived of it. Not only Latvia but other countries choose to add more grounds for deprivation of citizenship. The aim of this thesis is to analyse the five grounds for deprivation of citizenship stated in the Latvian Citizenship law and compare them to the citizenship laws in other countries. To reach this aim, the author analyses the definition of citizenship, the development of citizenship, five grounds for deprivation of citizenship that are included in the Latvian Citizenship law, as well as international regulations in relation to reduction of statelessness. As a result, the author concludes that deprivation of citizenship is still an important mechanism to ensure that the citizens do not pose threat to the state and are loyal to the state.
