Bakalaura darba nosaukums ir REACH regulas ietekme uz Patērētāju tiesībām. Darba izvirzītais mērķis – raksturot patērētāju tiesību izmaiņas, ko ieviesusi Eiropas Parlamenta un Padomes 2006.gada 18.decembrī pieņemtā Regula (EK) Nr.1907/2006, kas attiecas uz ķimikāliju reģistrēšanu, vērtēšanu, licencēšanu un ierobežošanu („Registration, Evaluation and Authorisation of Chemicals”), saīsinājumā REACH regula.
Lai šo mērķi sasniegtu, tika izvirzīti šādi uzdevumi:
•Iepazīšanās ar REACH likumdošanu;
•Patērētāju tiesību pozitīvo un negatīvo aspektu izvērtēšana;
•Izmaiņas ķīmisko vielu ražošanā un to ietekme uz ražotāju;
•Ražotāju saziņas pa piegādes ķēdi analīze.
Lai sasniegtu autora izvirzīto mērķi, darbs tika veidots no četrām savstarpēji saistītām nodaļām:
Pirmajā nodaļā tiek aprakstīts Patērētāju tiesības, to galvenie uzdevumi patērētāju interešu aizsardzības jomā, galvenās funkcijas, kontroles veicēju tiesības.
Otrajā nodaļā tiek aprakstītas un analizētas REACH regulā noteiktās vielu identificēšanas prasības un katras vielas analīzes veikšana par tās ietekmi uz cilvēku un vidi, kas nodrošinās patērētājiem preces drošumu.
Trešajā nodaļā tiek veikta patērētāja kā REACH regulas sastāvdaļas izpēte, tiek pievērsta uzmanība ražotāja saziņai pa piegādes ķēdi. Tiek apzināti galvenie ražotāja uzdevumi, tai skaitā - vielas lietošanas veidu apzināšana un ekspozīcijas scenārija sagatavošana.
Ceturtajā nodaļā tiek sīkāk aplūkotas patērētāju tiesību problēmas, kas tieši saistītas ar REACH regulu, apzinātas vairākas problēmas. Tiek izpētīta Latvijas patērētājiem ļoti būtiska problēma: REACH regula nosaka - nav datu par preci, nav preces, Skartas arī problēmas ar izejmateriālu piegādi no valstīm ārpus Eiropas Savienības, tā ierobežojot patērētāju izvēles brīvību.
Apkopojot un analizējot visu darbu, var redzēt galveno problēmu – REACH sadārdzina preces. Savukārt patērētāji iegūst vairāk informācijas un mazāku preču izvēles iespējas, kā arī radīsies to sadārdzinājums. The title of bachelor’s work is “The influence of REACH regulation on consumer rights”. The aim of work is to characterize the changes of consumer rights, initiated by Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18th of December, 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (abbr. REACH regulation).
In order to achieve this aim, following tasks were advanced:
•Introducing in REACH legislation;
•Evaluation of positive and negative aspects of consumer rights;
•Changes in producing of chemicals and their influence on the producer;
•Analysis of producers’ communication by supply chain.
In order to achieve the aim set by author, a work is formed of four interconnected chapters.
At the first chapter the REACH regulation, its main tasks in the field of consumer rights, main functions, and rights of control performers.
The second chapter describes and analyzes the requirements of identification of substances prescribed at the REACH regulation and performing of analysis of each substance about its influence on human and environment, which will ensure the safety of goods.
At the third part the study of consumer as a part of REACH regulation is performed, the regard is paid to the producer’s communication by supply chain. The main producer’s tasks are gathered including the exploration of kinds of substance’s usage and preparing the continuity of exposition.
At the fourth chapter the problems of consumer rights, directly connected with REACH regulation are considered. Substantial problem for Latvian consumers are studied: REACH regulation prescribes – no data about goods, no goods. The problems connected with delivering the raw materials from countries outside the European Union, thus the customer right of choice is restricted.
By summarizing and analyzing all the work, the main problem is seen – REACH raises the prices of goods. In their turn the consumers gain more information and less possibilities of choice of goods.
