Abstract

Darba tēma ir izvarošana. Izvarošanas sastāvs ir paredzēts Krimināllikuma 159.pantā. Dotais darbs ir sastādīts no trīm daļām.Pirmajā daļā tiek runāts par izvarošanas jēdzienu un vēsturi, izpētot izvarošanas regulējumu agrākajos likumos un salīdzinot ar mūsdienu Krimināllikumā ietverto izvarošanas sastāvu. Otrajā daļā tiek analizēts izvarošanas sastāvs, gan pamatsastāvs, gan sastāvi ar kvalificējošām pazīmēm. Trešajā daļā autore izskata ārvalstu krimināllikumos ietverto izvarošanas regulējumu un salīdzina to ar Latvijas Krimināllikuma 159.pantaā paredzēto sastāvu.

The topic of the thesis is the rape. The corpus delicti of the rape is foreseen in the Article 159 of the Criminal Law. The thesis is divided into three parts. In the first part the author discusses the concept of the rape and its history having explored the regulation of the rape in the previous legislations and having compared it with the corpus delicti of the rape as included in the Criminal Law. In the second part the author provides the analysis of the corpus delicti of the rape including both the principal corpus delicti and the corpus delicti with the qualifying features. In the third part the author examines the regulation included in the criminal laws of the foreign countries and compares it with the corpus delicti as foreseen in the Article 159 of the Criminal Law of the Republic of Latvia.
