Noziedzīgi nodarījumi militārajā dienestā

Abstract

Bakalaura darba tēma ir „Noziedzīgi nodarījumi militārajā dienestā”. Autore izvēlējusies bakalaura darbu rakstīt par tēmu „Noziedzīgi nodarījumi militārajā dienestā”, jo, autoresprāt, šī tēma Latvijā ir maz pētīta un vēlas tai pievērst uzmanību kā potenciālo pētījumu objektam. Autoresprāt, tēma ir aktuāla, jo vērojot noziedzīgo nodarījumu negatīvās tendences, nākas secināt, ka noziedzīgie nodarījumi militārajā dienestā ir ļoti izplatīti un nāktos veikts uzlabojumus Nacionālo bruņoto spēku darbībā, lai izskaustu šādas tendences. Pētījuma objekts ir noziedzīgs nodarījums militārajā dienestā- tā jēdziens, subjekts. Pētījuma objekts tiek aprobežots ar Krimināllikuma 343.- 349. pantiem- materiāli tehniskajiem noziedzīgajiem nodarījumiem militārajā dienestā. Tas veikts tādēļ, ka tieši materiāli tehniskie noziegumi ir vieni no bīstamākajiem noziedzīgajiem nodarījumiem militārajā dienestā, kas var graut bruņoto spēku statusu un rīcībspēju. Bakalaura darbs iedalīts trīs nodaļās. Pirmā nodaļa sastāv no pētījuma par noziedzīga nodarījuma militārajā dienestā jēdzienu un par šādu noziedzīgu nodarījumu subjektu. Otrā nodaļā veikts pētījums par noziedzīgo nodarījumu tendencēm bruņotajos spēkos un aplūkotas materiāli tehnisko noziedzīgo nodarījumu normas un veikta to analīze. Trešajā nodaļā veikts padziļināts pētījums par militārajām krimināltiesībām ārvalstīs.

The theme of the Bachelor’s Paper is "The criminal offences in the military service." The author has chosen to write a Bachelor's Paper on the topic "The criminal offences in the military service" because, in author’s opinion, this theme is little studied in Latvia and the author would like to draw attention to it as to the subject of potential researches. In author’s opinion, the theme is topical, because observing the negative trends of criminal offences, we must conclude that the criminal offences in the military service are very common and there should have been made improvements in the operation of the National Armed Forces to eliminate such tendencies. The study object is a criminal offence in the military service-its concept, subject. The study object is limited to the Criminal Law paragraphs 343.- 349th on material-technical criminal offences in the military service. This is done so as the material-technical criminal offences are among the most dangerous criminal offences in the military service, which can undermine the status and capacity of ArmedForces. The Bachelor’s Paper is divided into three chapters. The first chapter consists of a study of the concept of the criminal offence in the military service and the subject of such criminal offences. In the second chapter there is carried out the study on the tendencies of criminal offences in the Armed Forces and described the regulations of material-technical criminal offences and done their analysis. In the third chapter there is carried out an in-depth study of the military criminal law abroad.
