Patentu tiesības un konkurences tiesības nodibina svarīgu normatīvo bāzi, kas veicina tehnoloģiju attīstību un valsts ekonomikas izaugsmi. Lai gan abi tiesību institūti kalpo vienādam mērķim, konkurences tiesības var ierobežot patentētas tehnoloģijas īpašnieku, pastāvot noteiktiem apstākļiem. Darba ietvaros tika analizētas “īpašu” apstākļu robežas, kurus konstatējot var tikt ierobežota patenta īpašnieka civiltiesībās nostiprinātā darījumu slēgšanas brīvība.
Par svarīgākām problēmu kategorijām, kur rodas lielākie strīdi konkurences tiesību un patentu tiesību mijiedarbībā autore identificē patentu licencēšanas korelāciju ar konkurences tiesībās nostiprināto vienošanās aizliegumu, kā arī dominējošā stāvoklī esošā tirgus dalībnieka brīvības atteikties licencēt patentu atbilstību dominējošā stāvokļa ļaunprātīgas izmantošanas aizliegumam. Darba autore ir analizējusi Latvijas konkurenci regulējošās normas un iespēju tos piemērot, piedāvājot jaunu un izpratnei vieglāku normu redakciju. Tika analizēts arī Eiropas un ASV pastāvošais regulējums un tiesu prakse, modelējot iespēju to piemērot vietējam tirgum, konstatējot nepieciešamos uzlabojumus un sniedzot savus priekšlikumus Latvijas regulējuma pilnveidošanai. Patent Law and Competition Law set up an important legal regulation which facilitate technological development and growth of state economy. Despite the fact that both legal institutes have common goal Competition Law still has an opportunity to restrict patented technology owner in his behaviour in the market, if there are fulfilled certain circumstances. In the Master Thesis there are analyzed „special” circumstances which can be a ground for restricting the patent owner in his civil rights of treaty conclusion freedom.
The author identifies the following important problems that are connected with Competition and Patent Law mutual correlation: patent licensing vs. agreements between undertakings that can be abusive under Competition Law, also abuse of dominant position in patent licensing. In Master Paper were analyzed Latvian Competition regulation and practical approach of the mentioned regulation with proposals how to make the existing regulation more comprehensive. There was analyzed also European and USA regulation and case law, estimating the possibility to adapt the mentioned regulation to the local market.
