Īres maksas noteikšana un grozīšana

Abstract

Diplomdarbā „Īres maksas noteikšana un grozīšana” autors analizē Latvijas Republikas īres maksas noteikšanas tiesisko regulējumu. Darbā izmantoti starptautiskie un nacionālie normatīvie akti, judikatūra, tiesu prakses materiāli un apkopojumi. Tēmas ietvaros pētīti juristu viedokļi un skaidrojumi, kuri publicēti oficiālajā laikrakstā „Latvijas Vēstnesis”, tā pielikumos un interneta materiāli, kā arī atzītu dzīvokļu un īres tiesību speciālistu viedokļi un komentāri par LR Civillikuma, likuma „Par nomas uzturēšanās vietas” un likuma „Par dzīvokļa īpašumu” normām šajā sfērā. Darbs iztirzājuma daļa izkārtota trīs nodaļās ar apakšnodaļām. Pirmās nodaļas apakšnodaļās apskatīti vispārējie jautājumi, kas regulē īres maksas noteikšanu un grozīšanu. Otrās nodaļas ietvaros iztirzātas īres maksas sastāvdaļas, kritēriji, kas jāņem vērā nosakot īres maksu, kā arī atklātas problēmas, kas rodas piemērojot normatīvajos aktos noteikto īres maksas aprēķināšanas metodiku. Trešajā nodaļā sniegts ieskats ārvalstu praksē īres maksu regulēšanā. Autors darbā piedāvā vairākus atspoguļoto īres maksas regulējuma problēmu risinājumus – nepieciešamību veikt atsevišķu jaunu normu ieviešanu esošajos likumos, lai izmainīto esošo īres maksas noteikšanas.

In the diploma paper „Determination and amendment of rental” the author analyses types of rental determination and its legal regulation in the Republic of Latvia. There are international and national normative acts, court practice, court practice reports and summaries. Points of view and explanations of lawyers published in the official newspaper „Latvijas Vēstnesis” and its annexes, comments of recognized specialists on LR Civil Law, laws “On rent of residence space”, “On apartment property”, internet materials, views of renters and tenants on the theme. Layout of the theme is organized in three chapters. In the first two sub-chapters of the first chapter general questions are reviewed on regulation of rental determination. In the second chapter constituent parts of rental are considered, criteria to be taken into account when determining rental sum, also the revealed problems at application of methods defined by applied normative acts. In the third chapter insight in international practice is given in regulations of rental, also the best solution application possibility in Latvia. There are solutions/ways out offered in the work for the stated problem solution – necessity of rent court introduction, possibility for rent agreement registration in official register, the needed changes in procedure of rental calculations and others.
