Šī darba mērķis ir veikt nodrošinātā kreditora tiesiskā regulējuma juridiskās personas maksātnespējas procesā analīzi, atklājot nepilnības šī institūta tiesiskajā regulējumā.
Autore darbā atklāj problēmas, kas līdz šim Maksātnespējas likuma un Civilprocesa likuma grozījumu izstrādātājiem ir paslīdējušas garām, kā arī mezglu punktus, kas tiesību normu piemērotājiem rada domstarpības un sarežģījumus.
Autore secina, ka Maksātnespējas likumā un Civilprocesa likumā veiktie grozījumi ir uzlabojuši maksātnespējas regulējumu, tomēr tas joprojām ir nepietiekams nodrošinātā kreditora tiesību aizsardzības nodrošināšanai, tādējādi ir nepieciešams tos uzlabot, novēršot Maksātnespējas likumā kreditora jēdziena nepilnības un paplašinot nodrošinātā kreditora balsstiesības jautājumos, kas tieši vai netieši skar ieķīlāto mantu, kā arī grozot Civilprocesa likuma 563. panta otro daļu. The purpose of the master thesis is to analyze the insolvency process of a legal entity, highlighting the pitfalls in its legal framework.
Author discusses problems that have been omitted by the working group
standing behind the relevant amendments of the Insolvency Act and Civil
Procedure Act, as well as the key-aspects causing problems in practice and disputes among the practitioners.
Author comes to the conclusion that amendments that have been introduced to Insolvency Act and Civil Procedure Act have improved the legal environment; however still it is insufficient to ensure the protection of creditors thereby it needs to be improved further by eliminating shortcomings of the concept of creditor and by expanding the scope of voting rights of the
secured creditor in relation to matters that directly or indirectly relate
to the pledged assets, as well as by amending Article 563(2) of Civil
Procedure Act.
