Taisnīgums ir kolorīts jēdziens un cilvēces izpratne par to laika gaitā mainās atkarībā no vietas, laika un apstākļiem. Līdz ar to darba pirmajās trīs nodaļās tiek pētīta taisnīguma izpratne dažādos cilvēces attīstības vēsturiskajos posmos, sākot no antīkajiem laikiem līdz pat mūsdienām, vērtējot ievērojamāko antīko laiku domātāju, viduslaiku un jaunāko laiku juristu, filozofu un tiesību zinātnieku atziņas.
Ceturtajā darba nodaļā maģistrante vērtē, kāda loma taisnīguma realizācijā ir konstitucionālajai kontrolei vispār un kā mūsu valsts tiesiskajā realitātē ar konstitucionālās kontroles palīdzību tiek īstenotas vēsturiski aktuālās, ideālās taisnīguma idejas. Darbā tiek analizēts, kā savos spriedumos interpretē taisnīgumu, no kā to atvasina un ar kādu saturu piepilda Latvijas Republikas Satversmes tiesa, tādā veidā atspoguļojot un arī veidojot taisnīguma izpratni mūsdienu Latvijā. The principle of justice is a racy concept and human apprehension thereof changes in the course of time depending on place, time and circumstances. Thereby the first chapters of the paper study apprehension of the principle of justice during various historical periods of human progress, from ancient times up to the present, analyzing the opinions of famous ancient thinkers, medieval and recent lawyers, philosophers and legal scholars.
In the fourth chapter of the present paper a candidate for a master’s degree determines the role of constitutional control in realization of the principle of justice in general and the way the ideal, historically topical ideas of justice are realized in the contemporary legal reality of our country by means of constitutional control. The paper analyzes the way the principle of justice is interpreted in the decisions of the Constitutional Court of the Republic of Latvia, as well as derivation and content thereof, thus reflecting and creating apprehension of the principle of justice in contemporary Latvia.
