Personas uzrādīšanai atpazišanai fotorobota līdzība aizturētajai personai

Abstract

Izmeklēšanas darbību pamatā ir kādas personas identifikācija ar cilvēku, kas pastrādājis kādu likumpārkāpumu. Personas identifikāciju ir iespējams veikt dažādos veidos, piemēram, pēc pirkstu nospiedumiem, apavu nospiedumiem, DNS analīzes. Vienīgais identifikācijas veids, kura rezultāti vairumā gadījumu tiek apšaubīti, ir uzrādīšana atpazīšanai. Lai izprastu, kādi uzlabojumi šajā kriminālprocesa izmeklēšanas darbībā ir nepieciešami, ir jāveic sīkāka uzrādīšanas atpazīšanai analīze. Par darba mērķi autore ir izvēlējusies izpētīt, kā nodrošināti maksimāli efektīvas uzrādīšanas atpazīšanai nodrošināšanu. Risināmie problēmjautājumi ir uzrādīšanas atpazīšanai veikšanai nepieciešamo uzrādāmajai personai līdzīgo personu nodrošināšana un šo personu līdzības robežas, uzrādīšanas atpazīšanai efektīvākais veids, nepareizo identifikāciju cēloņi un to novēršana, uzrādīšanas atpazīšanai rezultāta kā pierādījuma lietā pieļaujamība, attiecināmība un ticamība.

In the bachelor paper “The presentation of the person for the identification” is based on the criminal procedure of Latvia and on the forensic science. The main issues that are discussed in the paper are the similar persons needed for the presentation of the persons for the identification and the borders of this similarity, the most efficacious form and grounds for the presentation of the person for the identification, causes for the false identifications and their prevention, the role of the results of the presentation of the person for the identification, their admissibility and credibility. Discussing these issues the author maintains the opinion that the most efficacious form for the presentation of the person for the identification is the direct form because in this form instead of shoving persons by photos or videotapes the shown persons are seen in their full height.
