Ģimene Latvijas tiesību vēsturē

Abstract

Diplomdarba galvenais pētījuma mērķis ir ģimenes jēdziena izpratne Latvijā. Ģimenes vēsturiskā pētniecība ir aktuāla, jo tikai izprotot tās vēsturisko rašanos Latvijas tiesību vēsturē, var secināt kā ģimenes tiesības ir attīstījušās un, ko Latvijas tiesību izpratnē saprot ar jēdzienu „ģimene”. Darbs sastāv no divām nodaļām un apakšnodaļām, kur katrā no tām ir Latvijas tiesību vēstures pētījums attiecīgā laika periodā. Pētījuma rezultātā ir secināts, ka izpratne par jēdzienu „ģimene” Latvijas tiesību vēsturē dažādos laika periodos ir atšķīrusies. Taču vienmēr Latvijas tiesībās par ģimeni ir uzskatīta tikai tāda cilvēku savienība, kas balstīta pretējā dzimuma savstarpējās attiecībās jeb attiecībās starp vīrieti un sievieti. Līdz ar to viena dzimuma personu savstarpējās attiecības Latvijas tiesību izpratnē nav uzskatāmas par ģimeni.

The general aim of the scientific work is a family in the Right’s history of Latvia. The historical research of the family is topical because only by understanding its historical emergence in the Right’s history of Latvia we can conclude that the rights of the family have developed and the significance of the term „family” can be understood better. Work contains two chapters and subchapters and each of them introduces a research of Right’s history in respective time period. As a result of the work a conclusion has been made that the understanding of the term „family” in the Right’s history of Latvia in different time periods has varied. Though always in the Rights of Latvia the family was reckoned only as a union of people based on relations between opposite sexes, that is, relations between a man and a woman. Wherewith the relations of one sex in the understanding of the Rights of Latvia cannot be considered as a family.
