Pasažieru tiesības uz kompensāciju lidojuma atcelšanas gadījumā Eiropas Parlamenta un Padomes Regulas (EK) Nr. 261/2004 ietvaros

Abstract

Bakalaura darbs vērsts un Eiropas Parlamenta un Padomes 2004. gada 11. februāra Regulas (EK) Nr. 261/2004 ar ko paredz kopīgus noteikumus par kompensāciju un atbalstu pasažieriem sakarā ar iekāpšanas atteikumu lidojuma atcelšanu vai ilgu kavēšanos analīzi. Darba mērķis ir analizēt vai tiek sasniegts Regulā izvirzītais mērķis. Darbā autore pētīs galvenos Regulas problēmu jautājumus, proti, Regulā ietvertā „ārkārtējo apstākļu”, kas var būt par pamatu gaisa pārvadātāja atteikumam izmaksāt pasažieriem paredzēto kompensāciju lidojuma atcelšanas gadījumā, jēdziena analīze un veikta, ar šī jēdziena interpretāciju saistītās problemātikas gaisa transporta jomā, izpēte. Īpaša uzmanība tiks pievērsta jautājumam, vai „ārkārtēju apstākļu” jēdziens būtu attiecināms arī uz tehniskiem lidaparāta bojājumiem. Tiks apskatīts arī jautājums, kas saistīts ar pasažieru tiesību uz kompensāciju saņemšanu efektīvu nodrošināšanu. Proti, tiks pētīts, vai gaisa pārvadātājam nepastāv iespēja izvairīties no Regulā paredzētās kompensācijas izmaksas pasažieriem un „ārkārtēju apstākļu” pierādīšanas pienākuma. Kā arī lidojuma ilgas kavēšanās un atcelšanas nošķiršana. Autores uzdevums šajā darbā ir rast atbildi uz jautājumu vai Regulā izvirzītais mērķis, kas ir garantēt pasažieriem to tiesību pilnvērtīgu aizsardzību, tiek sasniegs. Tāpat darbā autore meklēs arī iespējamos problēmu risinājumus.

Paper examines issues related to the application of EC Regulation No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights. Namely, author analyses the problems which are related to the fulfillment of the goal as set by the drafters of the said Regulation. Regulation provides for the compensation to the passengers whose flights have been canceled except in case the said cancellation is due to extraordinary circumstances. Even thought the scope of those extraordinary circumstances as set under the Regulation are essential, Regulation provides rather broad and vague definition which allows air carriers to apply their own interpretation to the said term and thus limit the rights of passengers as intended under the Regulation. One of the main concerns as emphasized by the author in the paper is whether technical problems with aircraft can be claimed to fall within the scope of “extraordinary circumstances”. Author presents her arguments to claim that inclusion of aircraft’s technical problems within the scope of “extraordinary circumstances” would jeopardize the attainment of the Regulation’s aim, namely compensating passengers for the problems faced while traveling by air. Author also presents the problem related to the burden of proof of those “extraordinary circumstances”. Author emphasizes that there is no marked borderline between the cancellation of a flights and its long delay. Thus, air carriers are in the possession to rely on the long delay of a flight even if it lasts for more than 24 hours in order to escape from the duty to pay compensations to passengers as provided under Regulation for canceled flights. Further to the performed analysis author has concluded that Regulation fails to fulfill the aim which it was set forth attain. Thus amendments should be made the Regulation to ensure that it serves its aim.
