Darba „Eiropas Cilvēktiesību tiesas judikatūras izmantošana tiesību normu piemērošanas procesā” mērķis ir noskaidrot teorētisko un praktisko pamatojumus šī judikatūras veida izmantošanai. Līdz šim Latvijas tiesību sistēmā ir izstrādāta pati judikatūras jēdziena ideja un tikai nedaudz ir pētīts jautājums par judikatūras atziņu veidiem un to piemērošanas metodēm. Šajā darbā ir mēģināts parādīt judikatūras atziņu vietu tiesu nolēmumos un šo atziņu turpmāko piemērošanu, atkarībā pēc tās satura un īpašībām.
Sākotnēji Latvijā Eiropas Cilvēktiesību tiesas piemērošanas pamatojumu skaidroja Satversmes tiesa. Vadoties pēc tīri pragmātiskiem kritērijiem Satversmes tiesa atzina Eiropas Cilvēktiesību tiesas judikatūras juridiski saistošo piemērošanas pienākumu. Latvijas tiesību zinātnieku darbos attīstījusies teorija, ka judikatūras izmantošanas pamatā ir tiesiskās vienlīdzības princips, tiesiskās drošības un tiesiskās paļāvības princips. Ja vadās pēc sociālo zinātņu atziņām, tad šāds uzskats ir pareizs. Šajā darbā ir parādīta cita pieeja judikatūras pamatojuma izsecināšanai.
Darbs ir vairāk veltīts teorētiskiem jautājumiem un tikai nedaudz ieskicēti Eiropas Cilvēktiesību tiesas judikatūras izmantošanas praktiskā pielietojamība, tāpēc tiesnesim-praktiķim šis pētījums varētu būt tikai interesants, bet ne tieši noderīgs. The aim of the Paper “Judicature of the European Court of Human Rights in Law Enforcement Process” was to identify theoretical and practical grounds for application of the said judicature. By the present time just the very idea of the concept of judicature has been worked out in the Latvian legal frame and the issue of judicature kinds and application methods has been studied just a little. This Paper is an attempt to show the role of judicature conclusions in court judgments and further application of the said conclusions depending on their content and specifics.
Initially, Latvia’s Constitutional Court used to explain the grounds for application of the judicature of the European Court of Human Rights. In terms of purely pragmatic criteria, the Constitutional Court acknowledges the binding obligation of application of the judicature of the European Court of Human Rights. In the works of Latvian legal scientists, a theory has emerged that application of judicature is based on the principles of legal equality, legal security and legal confidence. In terms of social sciences, this approach is correct. The author presents a different approach to identification of judicature grounds.
The Paper is dedicated rather to theoretical issues and has just some indications of practical application of the judicature of the European Court of Human Rights; therefore a judge-practitioner may find this work interesting but not of practical use.
