Adopcijas tiesiskā regulējuma attīstības tendences Latvijā no 1985. līdz 2000. gadam

Abstract

Darbs atspoguļo galvenās izmaiņas Latvijas adopcijas likumdošanā. Latvijā 20.gadsimta deviņdesmitajos gados notika nozīmīga tiesību sistēmas reforma, kuras laikā sociālistisko tiesību sistēmu nomainīja kontinentālās Eiropas tiesību sistēma. Lai parādītu šo pāreju detalizēti, darbā visi notikumi, kas saistāmi ar adopcijas jautājumu, ir sakārtoti hronoloģiskā secībā. Darbā ir izmantoti Latvijas, Austrālijas, Nīderlandes, ANO un ES tiesību avoti un literatūra. Darbā ir atspoguļotas galvenās adopcijas tiesiskā regulējuma attīstības tendences Latvijā dažādos laika posmos, arī mūsdienās. Autore norāda arī uz vērtību pārvērtēšanas ietekmi uz adopcijas likumdošanas attīstību. Pirmā nodaļa runā par adopcijas jēdzienu un raksturojumu kopumā. Otrā nodaļa apraksta adopcijas institūta attīstību laika posmā no padomju Latvijas laikiem līdz Latvijas iestāšanās ES. Visbeidzot trešā nodaļa atspoguļo šīsdienas likumdošanas harmonizācijas procesu atbilstoši Eiropas Savienības prasībām, šajā nodaļā uzsvars tiek likts uz Eiropas Cilvēktiesību tiesas praksi bērna tiesību jomā.

The work contains main changes in the legislation of adoption in Latvia. It focuses on the basic trends in the evolution of adoption law in the end of the 20th century and the developmental trends in this area in the contemporary period. The author describes Latvia’s move from the Socialist understanding of adoption law to the Roman-Germanic range of law, as well as the harmonization of Latvian adoption law with that of the European Union. Chapter I mainly talks about the contemporary adoption situation in Latvia. It mentions some differences between Latvian and Australian or Netherlandish adoption law. Chapter II describes the historical evolution of the adoption situation in Latvia from the Socialist understanding to the Roman-Germanic range of law. It also points out the main differences in the understanding of the adoption law and child rights in these periods. Chapter III talks about the harmonization of Latvian adoption law with the international rights – mainly human rights. The author studied some case-law of the European Court of Human Rights and pointed out some important conclusions of the ECHR. The main theme of this chapter is human rights, especially child's rights.
