Bakalaura darbs veltīts patēriņa kredītņēmēju tiesiskās aizsardzības problēmām Latvijā. Darba ietvaros nedaudz ir aplūkota patērētāju kreditēšanas vēsture pasaulē un cēloņi patēriņa kredītņēmēju stāvoklim šobrīd. Lai labāk izprastu Latvijā pastāvošo situāciju patērētāju kreditēšanā, darba ietvaros ir aplūkota tiesiskā aizsardzība kreditēšanā Eiropas Savienības, Amerikas Savienoto Valstu, Apvienotās Karalistes un Latvijas tiesību aktos.
Ir noskaidroti būtiskākie pārkāpumi patērētāju kreditēšanā Latvijā. No pakalpojumu sniedzēju puses tie ir netaisnīgi noteikumi patērētāju kreditēšanas līgumos un negodīgas komercprakses realizēšana pret patērētājiem, bet no patērētāju puses līgumā noteikto saistību neizpilde.
Galvenie veidi, kā nodrošināt patērētāju tiesību aizsardzību kreditēšanas gadījumā, ir panākt reālu tiesisko vienlīdzību starp kredīta devēju un kredītņēmēju, un patērētāja informēšana par viņa tiesību aktos noteiktajām tiesībām.
Šobrīd patēriņa kredītam ir liela ietekme uz ekonomiskajiem un sociālajiem procesiem valstī, un tādēļ nepieciešams izstrādāt jaunus likumdošanas aktus, kas regulētu patērētāju kreditēšanu un ar to saistītos jautājumus. Bachelor`s work is dedicated to the problems of borrower`s legal protection in case of consumer credit in Latvia. In this work the author slightly displays history of consumer credit in the world and the causes of the situation that consumer credit borrowers are in now. To better understand the current situation of consumer protection in crediting in Latvia, the author looks at legal protection of consumer crediting in the European Union, the United States of America, the United Kingdom and the Latvian legislation.
In Latvia the most significant violations of consumer crediting are unfair terms in consumer credit contracts and the realization of unfair commercial practices towards consumer from the creditor. And non-fulfillment of contract obligations from side of the debtor.
The main ways to provide consumer protection in the event of crediting is to achieve real legal equality between credit provider and borrower, and active consumer informing of his statutory rights.
Currently consumer credit has significant impact on the economic and social processes in the country, and it is therefore necessary to develop new legislation to regulate consumer credit and related issues.
