Darba mērķis ir aplūkot Valsts pārvaldes iekārtas likuma VII nodaļas „Sadarbība valsts pārvaldē” noteikumus no administratīvo tiesību teorētiskā un praktiskā tiesību piemērošanas viedokļa.
Darba tēmas novitāti un problemātiskumu pamatā atklāj sadarbības formas, kuru alternatīvas – starpresoru vienošanās un sadarbības līgums balstītas uz privāttiesībās izstrādātu institūtu – līgumu. Līguma institūta patapināšana sadarbības vajadzībām aktualizē sadarbības subjektu tiesiskā statusa, sadarbības formu nošķiršanas, noformēšanas un strīdu izšķiršanas problemātiku. Vienlaikus patapinātā līguma institūta apskatīšana pārējo publisko tiesību institūtu sistēmā atklāj arī citas tiesiskā regulējuma īpatnības vai problēmas. Piemēram, starpresoru vienošanās salīdzinājums ar iekšējo normatīvo aktu atklāj, ka teorētiski iespējamas to pretrunas, kuru novēršanai likumā nav atbilstošas vadlīnijas. Bet starpresoru vienošanās un publisko tiesību līguma pazīmju salīdzinājums atklāj to neatbilstību. The aim of the paper is to examine regulations of the VII Chapter “Co-operation in State Administration” of the State Administration Structure Law from the theoretical and practical point of view of the administrative law regarding the application of law.
In the grounds of the paper’s theme novelty and problematic character there are forms of co-operation, which alternatives – interdepartmental agreement and co-operation contract are based on the institute worked out in the private law – contract. Lending of the contract institute for co-operational needs update problems regarding the customs status of the co-operation subjects, seclusion and execution of the co-operation form and settlement of disputes. At the same time examination of the lent contract institute in the system of the rest public law institutes disclose other peculiarities and problems of the legal regulation. For instance, the comparison of the interdepartmental agreement with the internal normative act discloses, that contradictions are theoretically possible, whilst there is no guideline in the law regarding the prevention of ones. However the comparison of the interdepartmental agreement and public law contract indications disclose their incompliance.
