Tiesu izpildītāju institūcijas attīstība un perspektīva

Abstract

Diplomdarbs ir izstrādāts uz 69 lapaspusēm par tēmu “Tiesu izpildītāju institūcijas attīstība un perspektīva’’. Diplomdarbs sastāv no 4 nodaļām un tā izstrādāšanai izmantoti 53 bibliogrāfiskie avoti. Risinot tiesu izpildītāju institūcijas problēmas valstī, tiktu samazināti būtiski trūkumi, kā, piemēram, tiktu novērstas esošās likumdošanas nepilnības, minimalizēta korupcijas iespējamība, panākta parādu piedziņas procesa caurskatāmība, tiktu paaugstināta procesa efektivitāte un kvalitāte, kā arī paaugstināts profesijas prestižs. Lai novērstu zvērinātu tiesu izpildītāju sistēmas nepilnības, ir jāatklāj esošie trūkumi un jādefinē iespējamie risinājumi institūta uzlabošanai. Autors savā darbā pēta divas dažādas Eiropā pastāvošas tiesu izpildītāju institūcijas sistēmas un Starptautiskās tiesu izpildītāju asociācijas ietekmi profesijas attīstībā. Lai veiksmīgi tiktu sasniegts šī darba mērķis – izstrādāti priekšlikumi Zvērinātu tiesu izpildītāju institūcijas darbības pilnveidošanai Latvijā - diplomdarbā ir: izpētīta piedziņas dienesta vēsturiskā attīstība, lai noteiktu tiesu izpildītāju pagātnes mantojumu, kā rezultātā izdarīti secinājumi vai mūsdienu sistēma progresē savā attīstībā; apzināti svarīgākie problēmjautājumi, pie kuriem jāstrādā tiesu izpildītāju institūtam, lai tiesu izpildītāji veiksmīgi darbotos kā brīvās juridiskās profesijas pārstāvji; izpētītas divas Eiropas Savienībā pastāvošās tiesu izpildītāju sistēmas, lai salīdzinot tās, atklātu šo sistēmu priekšrocības un trūkumus, tādējādi tiek noskaidrots, kura sistēma darbojas efektīvāk un būtu pieņemamāka mūsu valstij.

The paper contains 69 pages and the topic is ‘’The developement of Judicial officers and their perspectives’’. There are 4 chapters in the work and 53 bibleographic sources have been used. Developing the problems of judicial officers in the country helps to solve important problems as, for example, the drawbacks of existing legislation can be prevented. The survey of the exaction can be improved, the efficiency and quality of the process can be raised and the prestige of the profession can be promoted. To prevent the drawbacks of judicial system, the existing shortcomings need to be discovered and the possible developements for improvement of the institution need to be defined. The author in her work investigates two different judicial systems, which exist in Europa and the influence of International Judicial association in the developement of the profession. To reach the aim of the work successfully (that is – to develop the suggestions of improvement of judicial officers in Latvia), in the work, there is: •The historical developement of exaction has been investigated to determine the historical heritage of judicial officers and as a result of that some conclusions about the question whether the system of nowadays has a progress in its developing, has been made; •The main difficulties and the judicial institute has to work with thesethese problems so that judicial officers can function successfully as representatives of free judicial profession; •Two judicial systems which exist in European Union has been investigated and compared. Their advantages and drawbacks has been showed and it is found out which system works more efficient and that’s why can’t be more usful for our country.
