Vīzu un uzturēšanās atļauju institūtu tiesiskā regulējuma atšķirības attiecībā uz lēmumu pamatošanu, apstrīdēšanu un pārsūdzēšanu un šo atšķirību juridiskās problēmas

Diplomdarba autors savā darbā „Vīzu un uzturēšanās atļauju institūtu tiesiskā regulējuma atšķirības attiecībā uz lēmumu pamatošanu, apstrīdēšanu un pārsūdzēšanu un šo atšķirību juridiskās problēmas” analizē atšķirīgos Latvijas Republikas normatīvo aktu regulējumus attiecībā uz lēmumu, kas saistīti ar vīzu un uzturēšanās atļauju izsniegšanu, pamatošanas pienākumu, kā arī šādu lēmumu apstrīdēšanas un pārsūdzēšanas iespējām.
Diplomdarba autors vispirms aplūko jautājumu par to, vai šādas atšķirības ir pieļaujamas. Darba gaitā tiek secināts, ka šādām atšķirībām nav pamata, jo vīzu un uzturēšanās atļauju institūti pēc būtības ir līdzīgi, kā arī līdzīgi ir šo institūtu mērķi.
Secinot, ka šādām atšķirībām nav pamata, diplomdarba autors meklē veidus, kā vīzu un uzturēšanās atļauju institūtu regulējumi attiecībā uz lēmumu pamatošanu, apstrīdēšanu un pārsūdzēšanu būtu harmonizējami. Līdz ar to darbā tiek izvērtēts, vai lēmumu, kas saistīti ar vīzu un uzturēšanās atļauju izsniegšanu, pamatošana, apstrīdēšana un pārsūdzēšana ir noregulēta tiesiski, kā arī kuram no institūtiem pamatošana, apstrīdēšana un pārsūdzēšana ir noregulēta atbilstošāk Latvijas Republikā dzīvojošo personu interesēm.
Izvērtējot pašreizējo vīzu un uzturēšanās atļauju institūtu regulējumu attiecībā uz lēmumu pamatošanu apstrīdēšanu un pārsūdzēšanu tiesiskumu, diplomdarba autors secina, ka abi minētie regulējumi ir tiesiski, neskatoties uz to, ka vīzu institūta regulējums lēmumu pamatošanas pienākumu, kā arī iespējas lēmumu apstrīdēt un pārsūdzēt neparedz. Pašreizējais vīzu institūta regulējums ir tiesisks, jo, pieprasot vīzu, ārzemnieks neatrodas Latvijas Republikas jurisdikcijā. Līdz ar to Eiropas cilvēka tiesību un pamatbrīvību aizsardzības konvencijā, kā arī Satversmes cilvēka pamattiesību katalogā minētās tiesības attiecībā uz ārzemniekiem šādos gadījumos nav piemērojamas. Izvērtējot pašreizējo vīzu un uzturēšanās atļauju institūtu regulējumu attiecībā uz lēmumu pamatošanu, apstrīdēšanu un pārsūdzēšanu lietderību, diplomdarba autors secina, ka Latvijas Republikā dzīvojošo personu interesēm atbilstošāks ir pašreizējais vīzu institūta regulējums, un tādēļ uzturēšanās atļauju institūta regulējums būtu tam jātuvina. The author in diploma work “The differences of the legal regulations of the visas and residence permits concerning the obligation to reveal the grounds of decisions and possibilities to dispute and appeal decisions, and legal challenges of such differences” analyzes a gap between the legal regulations of the visas and residence permits regarding the obligation to reveal the grounds of decisions as well as the possibilities to dispute and appeal decisions.
The author analyzes whether these differences in the legal regulations are permissible. It was concluded that there are no reasons for different approach in legislation since visas and residence permits are similar on its merits as well as on its objectives. In respect to conclusion that there are no reasons for differentiation, the author studies the options how the legal regulations of the visas and residence permits concerning the obligation to reveal the grounds of decisions and possibilities to dispute and appeal decisions could be harmonized.
The aim of the empirical analysis is to clarify whether the legal regulations of the visas and residence permits concerning the obligation to reveal the grounds of decisions and possibilities to dispute and appeal decisions are compatible with a norms of law of higher legal force as well as to compare which of the legal regulations concerning the issuance of visas or residence permits have been regulated agreeably to the interests of persons residing in the Republic of Latvia.
During the analysis of the legal regulations of the visas and residence permits concerning the obligation to reveal the grounds of decisions and possibilities to dispute and appeal decisions, it was concluded that above mentioned legal regulations are compatible with the norms of law of higher legal force, regardless the fact that regulation of visas does not foresee the obligation to reveal the grounds of decisions and possibilities to dispute and appeal decisions. The existing regulation of visas is legal since visa applicants are foreigners and do not possess within the jurisdiction of the Republic of Latvia when applying for visa at the diplomatic or consular representations abroad. Therefore, it was concluded that rights mentioned in the European Convention for Protection of Human Rights and Fundamental Freedoms and Human Fundamental Rights Catalogue of the Constitution of the Republic of Latvia can not be applicable regarding the issuance of visas and residence permits. The conclusion of diploma work shows that existing visa regulation corresponds to the interests of the residents of Latvia and therefore legal regulation of residence permits should be approximate to it.
