Advokatūras attīstība Latvijā 20. gadsimtā

Abstract

Diplomdarbā „Advokatūras attīstība Latvijā XX gadsimtā” ir pētīta advokatūras, advokātu un to darbību regulējošo tiesību normu vēsture un attīstība. Autors ir aplūkojis arī nozīmīgākos Latvijas advokatūras tiesiskos pavērsienus pirms 20. gs. Iepazīstoties ar jaunizveidotās Latvijas Republikas advokatūru, īpaša vērība pievērsta latviešu advokātu lomai Latvijas tiesu un tiesiskās sistēmas izveidē. Pētot Latvijas advokatūru PSRS okupācijas un K. Ulmaņa režīmu laikā, cita starpā, vērtēta advokatūras neatkarības principa ievērošana un PSRS īstenotā tiesu iestāžu, tostarp advokatūras, tīrīšanas un kadru nomaiņas politika. Vērtēta padomju advokāta loma, uzdevumi, kā arī advokātu darbības īpatnības Padomju Savienībā. Nobeigumā aplūkota Latvijas advokatūra pēc neatkarības atjaunošanas un būtiskākās tiesiskā regulējuma izmaiņas.

The Diploma Paper under the title„The Development of Advocacy in Latvia in the 20th century” examines the history and development of advocacy, attorneys and the regulating rights norms of their activities. The author of the Paper has viewed also the most important legal turning points of Latvian advocacy before the 20th century. Getting to know the newly established advocacy of the Republic of Latvia, particular attention is paid to the role of Latvian attorneys in the establishment of Latvian court and legal system. Examining Latvian advocacy during K. Ulmanis and the USSR occupation regime, the author of the Paper evaluates the observation of advocacy principles of independence, as well as the policy of purge and staff change of the USSR implemented legal institutions and advocacy. Within the framework of the Soviet advocacy, the role and tasks of an attorney are evaluated, as well as the peculiarities of attorney activities in the Soviet Union. The conclusion of the Paper deals with Latvian advocacy after the independence restoration and the most essential changes in the regulating rights norms of their activities.
