Maģistra darbā „Paredzamības klauzula ANO 1980. gada 11. aprīļa konvencijā Par starptautiskajiem preču pirkuma-pārdevuma līgumiem” tiek apskatīts un analizēts paredzama līguma pārkāpuma institūts un ar to saistītās problēmas šo tiesisko aizsardzības līdzekļu piemērošanā. Darba uzdevums ir izpētīt paredzama līguma pārkāpuma, saistību apturēšanas un atkāpšanās līgumos ar vairākām preču piegādēm tiesiskos aizsardzības līdzekļus, aplūkot zinātnieku polemiku, tiesu praksi kā valstu nacionālajās tiesās, tā arī starptautiskajās šķīrējtiesās, kā arī salīdzināt atsevišķu ārvalstu tiesību sistēmu regulējumu paredzama līguma pārkāpuma jēdziena definēšanā. Viens no uzdevumiem ir arī apskatīt paredzama līguma pārkāpuma institūta eventuālo vietu Latvijas tiesību sistēmā.
Konvencijas mērķis ir panākt starptautisko tirdzniecības tiesību unifikāciju. Autors secina, ka nepastāv paredzama līguma pārkāpuma, saistību apturēšanas un atkāpšanās līgumos ar vairākām preču piegādēm jēdzienu vienota izpratne un to piemērošanas prakse tiesās ir pretrunīga. Tādēļ darba rezultātā tiek piedāvātas jaunas, teorētiski un praktiski pielietojamas atziņas šo nesaskaņu mazināšanai un Civillikumā tiek ierosināti konkrēti grozījumi konstatētā likuma roba aizpildīšanai, reizē ar topošajiem Civillikuma grozījumiem. In work “Anticipatory clause under year 1980 UN Convention on Contracts for the International Sale of Goods” viewed and analyzed concept of anticipatory breach and related concepts of suspension performance and instalment contracts, as well as pointed out problems which arise in theory and practice and offer possible solutions. The scope of the Convention is international trade development and adopts unified terms to regulate international sales contract. Admittedly that unfortunately the scope of unified insight and application the concept's of anticipatory breach, suspension of performance and instalment contracts even at present isn't reach. For this reason author research various international sources, works by several authors, analyze linkage states jurisdiction as regards to this concept's. Research includes various case law examination and look for the concept of anticipatory breach, suspension of performance and instalment contracts in Latvia's legal system.
Author establishes that between many states and Convention drafters exists different interpretation of the concept of anticipatory breach. It means that Convention unification trends not amount its aim.
Consequently author design solutions related to resolving of the issue to as far as possible uniform insight model of anticipatory breach and related concepts of suspension of performance and instalment contracts based on research experience. Author moves out concrete amendments of the law in order to prevent existent imperfections at present modernization amendments of Civil law and include in to amendments concept of anticipatory breach and related concepts of suspension performance, and instalment contracts. Such amendments are necessary to be applicable not only as regards to international sales contracts, but also to domestic contracts to create contractual relations foreseeable and rapid.
