Kredīta un citu aizdevumu negodprātīga saņemšana un izmantošana

Abstract

Maģistra darba nosaukums ir „Kredīta un citu aizdevumu negodprātīga saņemšana un izmantošana”. Maģistra darba mērķis ir ar normatīvo aktu, zinātnisku monogrāfiju un publikāciju un tiesu prakses materiālu palīdzību atklāt kredītu un citu aizdevumu negodprātīgas saņemšanas un izmantošanas sastāva īpatnības un ar to saistīto problemātiku. Maģistra darba ievadā ir pamatota izvēlētās tēmas aktualitāte un nozīme, kā arī definēti sasniedzmie mērķi un metodes to sasniegšanai. Pirmajā nodaļā ir analizēti dažādos laika posmos Latvijā spēkā esošie krimināllikumi un tajos iekļautais regulējums attiecībā uz kredīta un citu aizdevumu negodprātīgu saņemšanu uz izmantošanu. Otrajā nodaļā ir aplūkots Krimināllikuma 210.panta sastāva objektīvās pazīmes, tajā skaitā, noziedzīga nodarījuma objekts un priekšmets, kā arī objektīvā puse. Trešajā nodaļā ir analizēts Krimināllikuma 210.panta sastāva subjektīvās pazīmes. Šās nodaļas apakšnodaļā ir aplūkota krāpšanas nošķiršana no kredīta vai cita aizdevuma negodprātīgas saņemšanas un izmantošanas. Maģistra darba ceturtajā nodaļā ir aplūkots ārvalstu tiesiskais regulējums saistībā ar noziedzīgiem nodarījumiem, kas vērsti pret kreditoru interesēm, salīdzinot to ar Krimināllikumu. Kopsavilkumā ir apkopoti maģistra darba izstrādes gaitā iegūtie secinājumi un piedāvātās tēzes. Izmantoto avotu saraksts ir pievienots darba beigās un satur 76 vienības.

The title of the Master’s Paper is „Unfair obtaining and usage of credit and other loans”. The aim of the Master’s Paper is to reveal the structural peculiarities of unfair obtaining and usage of credit and other loans and similar problems with the help of laws and regulations, scientific monographs and publications, as well as juridical materials. The introduction of the Master’s Paper states the importance of the current research theme and its significance, also the aims and methods for their achievement are defined. In the first chapter the author analyzes the criminal laws valid in different periods of time in Latvia and regulations included in relation to unfair obtaining and usage of credit and other loans. The second chapter deals with the objective indications of the Section 210 of the Criminal Law, object and subject of the criminal offence, as well as its objective side. The third chapter deals with the subjective indications of the Section 210 of the Criminal Law. The subchapter explains the difference between the fraudulence and unfair obtaining and usage of credit and other loans. In the fourth chapter of the Master’s Paper the foreign juridical regulations in connection with criminal offences against the interest of the creditors are examined and compared with the Criminal Law. In conclusion the results of the research and the theses offered in the Master’s paper are summarized. The bibliography list contains 76 resources attached at the end of the work.
