Krimināltiesību normas nosaka ne tikai kriminālatbildības iestāšanās pamatu un paredz noziedzīgus nodarījumus, bet arī norāda kritērijus, kas ļauj norobežot noziedzīgu rīcību no uzvedības, kas tikai pēc objektīvajām pazīmēm līdzīga noziedzīgai.
Diplomdarba nosaukums: “Nepieciešamā aizstāvēšanās kā kriminālatbildību izslēdzošs apstāklis”. Darba izstrādāšanas laikā analizēti gan Latvijas, gan ārvalstu normatīvie akti, pētīta juridiskā literatūra un analizēta tiesu prakse. Darbs sastāv no četrām nodaļām. Pirmajā nodaļā atspoguļota apstākļu, kas izslēdz kriminālatbildību, tiesību institūta vēsturiskā attīstība Latvijā 20.gadsimtā. Otrajā nodaļā rakstorota un analizēta apstākļu, kas izslēdz kriminālatbildību, būtība. Turpmākajās nodaļās raksturoti un analizēti nepieciešamās aizstāvēšanās tiesīguma nosacījumi, kā arī aplūkotas problēmas, kas saistītas ar nepieciešamās aizstāvēšanās robežu pārkāpšanu.
Kopsavilkumā tēžu veidā atspoguļotas pētījuma laikā saskatītās problēmas un sniegti to iespējamie risinājumi. Criminal law rules does not only define the criminal offences and circumstances of the criminal liability, but also declare the criterion, that make it possible to differentiate the criminal behaviour of the person from behaviour, that is only outwardly similar to the criminal- circumstances, that exclude criminal liability. The law must guarantee the social order and protect the individuals, society’s and country’s interests, but as we know it is not always possible. Circumstances that exclude criminal liability, guarantees person’s immunity against criminal prosecution in the situation, when harm has been caused to the important interests for the purpose of achieving a socially significant goal.
The theme of the research is “Necessary defence as a circumstance, which exclude criminal liability.” The research is written, analysing the legislation of Latvia and other countries, researching special law literature and legal practice. The main goals of the research is to define the circumstances that exclude criminal liability, to describe in essence of necessary defence and analyse the problems of their interpretation in special law literature.
The research consists of four chapters. The first chapter introduces the historical development of legal provision since XX century. In the second chapter emphasizes the circumstances, that exclude the criminal liability in original institute of the criminal law, and clarifies the condition of the circumstances. In the next chapters author defines conditions of the necessary defence, legal conditions of the necessary defence and analysing the problems of the necessary defence and its border violation. In conclusion of this research the author reviews the problems as well as possible solutions.
