Starptautisko tiesību regulējuma objekts un nošķiršana no nacionālajām tiesībām

Abstract

Darbā analizēta starptautisko un nacionālo tiesību nošķiršanas problemātika. Pašlaik starptautiskā līmenī arvien plašāk tiek regulēti valsts iekšējā kompetencē esoši jautājumi, tāpēc rodas neskaidrības par valsts suverenitātes jēdzienu un valsts nozīmi vispār. Autora ieskatā starptautiskās un nacionālās tiesības nošķiramas pēc diviem galvenajiem kritērijiem – regulējamo attiecību loka un šo tiesību veidošanās kārtības. Starptautiskās tiesības regulē tikai attiecības ar ārvalsts elementu un tām ir horizontāls (līgumisks) raksturs. Tomēr jārunā arī par atsevišķām starptautiskām tiesībām, kam ir vertikāla iedarbība – tās iespējams apzīmēt kā „pārnacionālas tiesības”.

This paper contains problem analyses of separation between national and international law. Presently the tendency of regulating state internal affairs on the international level can be more widely observed. This raises the question about the concept of state sovereignty and about the role of the state in general. The author of the research offers a view which does not contradict with the traditional understanding of state sovereignty, and, at the same time, does not reduce the role of international law in regulation of international affairs.
