Maģistra darbā “Nepilngadīgais apsūdzētais kriminālprocesā” izpētīti galvenie jautājumi, kas saistīti ar nepilngadīgā apsūdzētā procesuālā stāvokļa regulējumu kriminālprocesā, analizētas problēmas, kas saistītas ar nepilngadīgā aizstāvību, izmeklēšanas darbību veikšanu un procesuālo piespiedu līdzekļu piemērošanu.
Darbā ir apskatītas īpatnības procesā, kad noziedzīga nodarījuma subjekts - apsūdzētais ir nepilngadīgā persona. Jāmin, ka KPL jautājumi, kas saistīti ar nepilngadīgo iesaistīšanu kriminālprocesā būtu jāreglamentē detalizētāk – atsevišķā nodaļā, lai akcentētu īpašo krimināllietas izmeklēšanas un iztiesāšanas kārtību, kā arī jānosaka stingrākas prasības advokātiem, procesa virzītājiem un tiesnešiem, kuri strādā ar nepilngadīgajiem apsūdzētajiem.
Īpašie nepilngadīgo kriminālprocesa noteikumi ir virzīti galvenokārt uz šo personu aizsardzību no nepamatotas apsūdzības celšanas, uz taisnīgu lietas izlemšanu, kā arī lai nodrošinātu jebkuru iedarbības līdzekļu izvēles samērīgumu ar nepilngadīgā personības īpatnībām un izdarītā noziedzīgā nodarījuma apstākļiem. Jāņem vērā apstāklis, ka nepilngadīgajam ir ierobežotas spējas pašam pilnvērtīgi realizēt tiesības uz aizstāvību, spējas saprast kriminālprocesa norises kārtību, apzināties un izpildīt savus pienākumus kā procesa dalībniekam.
Tomēr veicot jebkuru izmeklēšanas darbību attiecībā uz nepilngadīgo jāievēro īpaša piesardzība un jāizvēlas īpaša taktika to veikšanai, jo nepilngadīgais atšķirībā no pieaugušā ir daudz jūtīgāks pret dažādām pārmaiņām un darbībām, kuras veic amatpersona, kurai ir tiesības veikt kriminālprocesu un tas jādara tā, lai pēc iespējas atstātu uz nepilngadīgo pēc iespējas mazāku negatīvo ietekmi.
Arī piemērojot nepilngadīgajam apsūdzētajam procesuālos piespiedu līdzekļus jāievēro īpaši noteikumi, ņemot vērā šo personu vecumam piemītošās psiholoģiskās īpatnības (strauja fiziskā un garīgā attīstība; intensīvs personības veidošanās posms, ko ietekmē gan ārējie, gan iekšējie faktori un citas īpatnības). Ar brīvības atņemšanu saistītie piespiedu līdzekļi piemērojami tikai izņēmuma gadījumos, kad cits piespiedu līdzeklis nevar nodrošināt efektīvu un pilnvērtīgu lietas izskatīšanu. In the thesis “A Minor Defendant in the Criminal Procedure” the main subjects connected with the defendant’s procedural status regulation in the criminal procedure have been explored and the issues connected with the defendant’s defence, the process of investigation and the adaptation of procedural coercive methods have been analysed.
In the research the peculiarities during the process have been looked at when the subject of the criminal act – defendant is a minor. It must be mentioned that the issues of the criminal process law connected with the involvement of a minor should be reflected in more details – in a separate section to emphasize the specific procedure of the investigation and trial of the case; also more strict demands for lawyers, process guides and judges, working with minor defendants, should be determined.
Specific laws of the criminal procedure of minors are guided mostly to the defence of those persons from invalid accusation and to just trial; also to ensure adequacy of any efficacy aids chosen with the minor’s individuality and the circumstances of the criminal act. It should be taken into account that minors have limited abilities to exercise completely their rights to defence, to understand the procedure of the criminal action and to be conscious of their obligations and to fulfil them as participants of the process.
However, during any investigation regarding a minor specific caution should be kept and specific tactics should be chosen, because the minor unlike adult is much more sensible to alterations and actions that are carried out by an officer who has rights to carry out criminal action, and it must be done so that the negative impact left on the minor should be as little as possible.
Also when adapting procedural coercive methods to a minor, specific laws should be observed, taking into account the psychological peculiarities of the persons of that kind of age (rapid physical and mental development; intensive period of the development of an individual that is influenced by exterior and interior factors and other peculiarities). Coercive methods connected with imprisonment are adapted only exceptionally when other coercive methods can not ensure effective and complete judgment of a case.
