Eksporta kredīta izpratne direktīvas 98/29/EK kontekstā

Abstract

Diplomdarbā „Eksporta kredīta izpratne direktīvas 98/29/EK kontekstā” ir pētīta vidēja un ilgtermiņa eksporta kredīta ietekme uz konkurenci Eiropas Kopienā, pastāvošās problēmas starptautiskajā konkurencē saistībā ar eksporta kredītu vidēja un ilgtermiņa darījumiem, apskatīta eksporta kredīta saderība kontekstā ar Pasaules Tirdzniecības organizācijas līgumiem, pievērsta uzmanība Eiropas Kopienas centieniem regulēt un vienveidot šo valsts atbalsta instrumentu, kā arī sniegts ieskats Latvijas normatīvajos aktos, kas regulē šo nozari. Sevišķa uzmanība darbā ir veltīta teorētisko pamatnostādņu izpētei Eiropas Padomes direktīvas 98/29/EK kontekstā: direktīvas normas veicina konkurenci traucējošo faktoru mazināšanos Eiropas Kopienā un jaunattīstības valstu integrēšanos starptautiskajā tirdzniecībā. Diplomdarbam ir gan teorētiska, gan praktiska nozīme. To var izmantot gan kā informācijas ieguves materiālu, lai gūtu vispārēju ieskatu Eksporta kredīta sistēmas būtībā, gan kā pētniecisku darbu attiecībā uz vidēja un ilgtermiņa eksporta kredītu direktīvas 98/29/EK kontekstā. Darbs ir strukturēts trīs nodaļās ar apakšpunktiem. Pirmā nodaļa apskatīta Eksporta kredīta būtība, vēsturiskā attīstība un loma starptautiskajā tirdzniecībā. Otrajā nodaļā sniegts Eiropas Padomes direktīvas 98/29/EK ievada, preambulas un pantu analīze kontekstā ar Eiropas Kopienas dibināšanas līgumu, starptautiskajiem līgumiem un pastāvošo praksi. Trešajā nodaļā sniegts ieskats attiecībā uz Direktīvas 98/29/EK preambulas 13.punktā minēto Ekonomiskās sadarbības un attīstības organizācijas „Vienošanās par vadlīnijām attiecībā uz oficiāli atbalstītiem eksporta kredītiem”. Darbs tiek noslēgts ar secinājumiem, kas ir gūti, izvērtējot eksporta kredīta izpratni vidēja un ilgtermiņa darījumiem Direktīvas 98/29/EK kontekstā, kā arī tiek sniegti priekšlikumi normatīvo aktu pilnveidošanai.

Diploma work „Comprehension of export credit in context of directive 98/29/EC” was elaborated by Andis Prieditis, student of Faculty of Law of University of Latvia, during spring semester of year 2008. Diploma work mainly pays attention to clarify the comprehension of export credit in context of Council directive 98/29/EC on harmonisation of the main provisions concerning export credit insurance for transactions with medium and long-term cover. The study of Council directive 98/29/EC linked up with international contracts of General Agreement on Tariffs and Trade, especially to the “The agreement on subsidies and countervailing measures” and Organisation for Economic Co-operation and Development “Arrangement on officially supported export credits”. Wherewith diploma work shows the medium and long term export credits not only from the sight of Council directive 98/29/EC, but also from the sight of contracts of the World Trade organization. In the same way through the study of mentioned Council directive diploma work shows the main problems of comprehension of export credit in the international arena. Similarly diploma work displays the viewpoint of opponents of export credits on the official support provided by or on behalf of a government for export. Diploma work is focused on two main issues – Council directive norms makes competitions obstructive factors abatement on market distortion in European Community and what kind of role medium and long-term export credit insurance plays in trade with developing countries and does it foster their integration into the world economy. „Comprehension of export credit in context of directive 98/29/EC” has theoretical and practical meaning. Diploma work is useful to gain information of medium and long term export credits, export credit agencies, its role on world export and gives insight to the main documents on this field. Furthermore diploma work gives analyze of main provisions of Council directive and provides suggestions on the field of export credits in national legislation. In general author of this work comes to a conclusion that medium and long term export credits actually is the export subsidy and it is more trade policy instrument than it helps for developing countries to foster their integration into the world economy.
