Civillikuma 1.panta piemērošanas problēmas

Abstract

Darba mērķi ir noskaidrot Civillikuma (Turpmāk - CL) 1. pantā ietvertā labas ticības principa piemērošanas būtiskākās problēmas un sniegt to iespējamos risinājumus. Iepazīstoties ar Latvijas tiesu prakses materiāliem un atvasināto publisko tiesību juridisko personu izdotajiem lēmumiem, tiek identificētas CL 1. panta piemērošanas dažādas dabas problēmas. 1. nodaļā tiek analizētas no juridiskas terminoloģijas nepareizas lietošanas izrietošas CL 1. panta piemērošanas problēmas. Ņemot vērā labas ticības principa pielietošanas konkrēto gadījumu pārzināšanas fundamentālo nozīmi CL 1. panta sekmīgā piemērošanā, 2. nodaļā autore pievēršas CL 1. panta konstatēšanas praktiskām grūtībām, ar ko saskaras tiesību piemērotāji. 3. nodaļā, apskatot izplatītākās CL 1. panta piemērošanas sekas, tiek analizētas labas ticības principa un privātautonimijas principa savstarpējās attiecības. Uzmanība tiek pievērsta darba gaitā konstatēto problēmu nelabvēlīgai ietekmei uz civiltiesisko sabiedrību, kā arī iespējamajiem problēmu risinājumiem. Lai celtu CL 1. panta praktisku efektivitāti, autore piedāvā Civillikuma atsevišķu normu grozījumus, dod ieteikumus tiesību piemērotājiem, kuri var palīdzēt vieglāk un precīkāk konstatēt CL 1. panta pārkāpumu un šo normu piemērot pareizi. Identificēto problēmu ilustrēšanai un piedāvāto risinājumu pamatošanai plaši izmantoti ne tikai Latvijas, bet arī ārvalstu tiesību zinātnē izteiktie viedokļi un pieredze labas ticības principa piemērošanā, kā arī Eiropas tiesību harmonizēšanai veltītā literatūra.

The purpose of this graduation paper is to ascertain the main problems of applying Article 1 of the Civil Code of Latvia containing the good faith principle (hereafter – Article 1) and to come up with their possible solutions. While getting acquainted with the Latvian jurisprudence materials and decisions issued by the Latvian administrative authorities, the problems of applying Article 1 are identified. In the chapter 1 the problems arising from the improper use of the legal terminology are analyzed. Taking into consideration the fundamental importance of having a good knowledge of particular occasions when the Article 1 has to be applied, the author focuses on the practical difficulties lawyers and judges in particular are dealing with in the chapter 2. In the chapter 3 considering the most common legal consequences of the application of the Article 1 the interaction of the ”good faith” principle and the freedom to determine the content of the contract is analyzed. The negative effect on society and possible solutions of indicated problems are emphasized. To improve the effectiveness of the Article 1 amendments to some norms of the Civil Code as well as recommendations to the persons applying laws are offered to simplify the determination of the violation of Article 1 as well as facilitate proper application of this norm. To illustrate the problems determined materials of legal practice of Latvian courts and statements made by foreign specialists are used as well as legal literature on the harmonization of the European Law.
