Kombatantu statuss asimetriskajā karā

Abstract

Bakalaura darbā „Kombatantu statuss asimetriskajā karā” pēta piemērojamo humanitāro tiesību regulējumu konfliktos, kam ir starptautisks raksturs, tomēr viena no pusēm nav uzskatāma par valsti un ignorē kara tiesības. Tiek analizēta ASV prakse tā saucamajā karā pret terorismu, jo ASV ir vistiešāk skāris jaunā tipa apdraudējums starptautiskajam mieram.

Darbs strukturēts vispirms apskatot asimetriskā kara jēdzienu un humanitāro tiesību piemērošanas īpatnības šādā konfliktā. Darba otrā nodaļa apskata klasisko humanitāro tiesību izpratni par kombatantu statusu, likumīga un nelikumīga kombatanta jēdzienus, karagūstekņa statusa kritērijus, kā arī Ženēvas Konvenciju 1977. gada Papildprotokolu ieviestās izmaiņas humanitārajās tiesībās. Atsevišķa nodaļa veltīta situācijas analīzei pēc 2001. gada 11. septembra teroristu uzbrukuma ASV. Aplūkota ASV prakse karā pret terorismu, problemātika, kas saistās ar kara tiesību attiecināšanu uz šādu konfliktu, Al-Kaida un Taliban kaujinieku statusa atšķirības. Atsevišķas apakšnodaļas veltītas arī tiesībām iegūt informāciju no sagūstītiem pretinieka kombatantiem un asimetriskā konflikta kombatantu statusa evolūcijas perspektīvām.

Secināts, ka saskaroties ar jaunā tipa apdraudējumu pastāv funkcionāls pamats piemērot kara tiesības, ka asimetrisko taktiku lietojums nav pamats uz konfliktu neattiecināt kara tiesības un nav iespējama starptautiska rakstura bruņota konflikta pastāvēšana, uz kuru humanitārās tiesības nav attiecināmas. Ja humanitāro tiesību normas nespēj asimetriskos kombatantus pietiekami aizsargāt, piemēram, neparedzot karagūstekņa statusu, akcentēta vispārējo cilvēktiesību normu sniegtā aizsardzība.

The paper „Status of Combatants in Asymmetric Warfare” explores the applicable Humanitarian Law framework to conflicts of international nature where one of the belligerent parties cannot be regarded as a State and ignores the Laws of War. The practice of United States in the so called war on terror is analysed extensively since United States have had the most direct experience with the new type of threat to international peace and security.

The paper is structured by looking into the concept of asymmetric warfare and the implications of application of Humanitarian Law to these types of warfare. The second section of the paper inspects the mainstream interpretation of Humanitarian Law protections awarded to combatants, the concept of lawful and unlawful combatants, the criteria for POW status as well as the amendments to Humanitarian Law by the Additional Protocols to Geneva Conventions. Separate section is devoted to the development of Humanitarian situation after 9/11 terrorist attacks on United States. The paper explores the practice of United States in the war on terrorism, issues with respect to applicability of Laws of War to these kinds of conflict, status differences of Al-Qaida and Taliban belligerents. Separate sub-sections are devoted to the right to obtain information from captured enemy combatants and the evolution perspectives of combatant status in asymmetric conflict.

The author concludes that there is a functional basis for application of Laws of War to the new type of threat, use of asymmetric tactics cannot be the basis for ignoring the Laws of War and the existence of international armed conflict where Humanitarian Law does not apply is impossible. If Humanitarian Law does not provide sufficient protection to combatants, e.g., does prescribe POW status, emphasis is placed on the protections provided by universal Human Rights.
