Zusammenfassung
Bakalaura darba temats ir „Cietsirdība un vardarbība pret nepilngadīgo”. Šajā bakalaura darbā tiks analizēta vardarbīga un cietsirdīga izturēšanās ar nepilngadīgo, liekot uzsvaru uz fiziska un emocionāla rakstura noziedzīgām darbībām, neskarot seksuālas vardarbības problēmu.
Ņemot vērā to, ka bērns pats nevar par sevi parūpēties un pasargāt no apdraudējuma, viņam jānodrošina īpaša aizsardzība un gādība, lai viņš varētu pilnvērtīgi attīstīties un adoptēties sabiedrībā. Savukārt fiziska un psihiska ietekmēšana no pieaugušas personas puses atstās sekas uz visu turpmāko bērna dzīvi. Pasargājot bērnu no vardarbības ģimenē, mēs pasargājam arī nākamas paaudzes bērnus no cietsirdīgas izturēšanās, jo bērns, kurš ir cietis no saviem vecākiem turpmāk nespēs veidot veselas ģimenes attiecības.
Darba gaitā tiks izpētīts bērnu tiesību starptautiskais regulējums, aplūkoti Latvijas normatīvie akti, saskaņā ar kuriem tiek nodrošinātas un aizsargātas bērnu intereses Latvijas republikā mūsdienās, kā arī aplūkots kā tas tika darīts XX. gadsimta garumā, analizējot 1933.gada Sodu likuma un Latvijas PSR kriminālkodeksa normas. Tiks analizēta Krimināllikuma 174.panta sastāva analīze, pēc kā minēta norma tiks salīdzināta ar ārvalstu, pārsvarā Eiropas Savienības valstu, krimināllikumiem. Autore pievērsīsies arī vardarbības pret bērnu psiholoģiskam novērtējumam, un mēģinās piedāvāt šī temata aktuālāko problēmu risinājumu. The topic of this thesis is „Cruelty Towards and Violence Against a Minor”. It analyses cruelty towards and violence against a minor, making an emphasise on physical and emotional domensions of malfeasance without paying attention to sexual abuse complexities.
Taking into account the incapacity of a child to take proper measures of protecting itself from potential endangerment it is of primary objective to take charge of its protection and care as for it could follow the way of complete development and get involved by the society. As for physical and psychical influence by an adult person it may have impacts upon the further life of a child. By retaining a child from household violence we are also protecting next children generations from cruel treatment as a child, because person, who has been a victim of his own parents, would be unable to establish sound family relationship.
By conduct of the research of this thesis author has analysed international regulation of children rights protection, examined legislation of the Republic of Latvia that is concerned with protection and auspices of children legal interests it to-day Latvia, and also reviewed that has been done during the course of 20.century by analysing Penalty Law of Republic of Latvia of 1933, Criminalcode norms of the Soviet Republic of Latvia. It will reveal the analysis of the structure of article 174 of Criminal law so as to conduct the comparative examination of this norm with corresponding norms of other states, predominantly those of the European Union. Author also will concern the psychological appreciation of violence against child and will propose adequate solution problems of existing problems coming under this topic.
