Tiesību principu loma Latvijas tiesību sistēmā un to ietekme uz citiem tiesību avotiem

Abstract

Darba mērķis ir izpētīt tiesību avotus un noteikt tiesību principu lomu tiesību sistēmā, kā arī analizējot tiesību principus, noteikt tiesību principu īpatnības, to dabu un izpausmi un kādā veidā tie mijiedarbojas ar citiem tiesību avotiem. Darbā tiek apskatītas tiesību principu funkcijas un tiesību principu divējāda daba. Šis pētījums palīdzēs izprast tiesību principu jēgu, to īpatnības, ka arī izveidos vienotu izpratni par tiesību avotu mijiedarbību. Darbā detalizēti tiek apskatīti tiesību avoti, atsevišķi tiesību principi un tiesību principu mijiedarbība ar citiem tiesību avotiem. Autors nonāca pie secinājumiem, ka tiesību principi ietekme citus tiesību avotus, kas palīdz veidot vienotu, funkcionējošu un balansētu tiesību sistēmu.

The aim of this work is to analyze the structure of principles of law and see how sources of law work together. While author analyzed the principles of law, he found a few unique features like principles of law dual nature and principles functions. Functions of the principles of law are: to create a law (law making function, source of law function), lawfulness control and interpretation function. All of the sources of law are working together to maintain the balance in the system of law. For better or worse, but sources of law interact amongst themselves. The main problem that is analyzed in this work is: how the sources of law interact amongst themselves, how can they assure the work of the law system as a whole balanced mechanism and what is the role of the principles of law in the system of law.
