Darba „Cietušā tiesību vispārīgie pamatprincipi kriminālprocesā” mērķis ir izpētīt šobrīd spēkā esošā KPL 97. pantu, izvērtējot un analizējot cietušā tiesību vispārīgos pamatprincipus, piedāvājot arī problēmu risinājumus.
Pirmajā nodaļā autore apskata cietušā jēdziena vēsturisko attīstību Latvijas PSR Kriminālkodeksā un Latvijas Kriminālkodeksā, lai izprastu jēdziena izcelsmi un izvērtētu cietušā nozīmi tā laika spēkā esošajos normatīvajos aktos. Tiek pētīts arī cietušā jēdziens mūsdienu kriminālprocesā, lai izprastu tā nozīmi un statusu šī brīža spēkā esošajos normatīvajos aktos. Autore saskata arī vairākus problēmu jautājumus, kā piemēram to, ka būtu nepieciešams regulēt faktiski cietušo personu statusu kriminālprocesā, kā arī vairāk pievērsties jautājumu risināšanai par privātās apsūdzības lietām un cietušo statusu tajās.
Otrajā nodaļā autore izvērtē cietušā tiesību vispārīgos pamatprincipus, balstoties uz KPL 97. pantu, analizējot to piemērotību mūsdienu normatīvajiem aktiem un piedāvājot atbilstošus problēmu risinājumus. Autore secina, ka, lai arī pašreizējais regulējums ir vērtējams pozitīvi, tam joprojām nepieciešami daudzi uzlabojumi, kas atrisinātu daudzas problēmas praksē.
Autore uzskata, ka nav vienas lielas problēmas, kuru varētu atzīt par galveno, saistībā ar cietušā tiesību vispārīgajiem pamatprincipiem, bet gan daudzas mazas, kurām nepieciešams risinājums, lai veiksmīgāk pilnveidotu KPL vispār. Cietušā statusam kriminālprocesā vajadzētu pievērst vēl lielāku uzmanību, jo šī tēma ir un paliks aktuāla, par ko liecina arī statistikas dati.
Pozitīvi vērtējams, fakts, ka cietušie ar vien vairāk sāk izmantot un izprast savas tiesības, tādā veidā veiksmīgāk aizsargājot savas intereses. The objective of work "The general principles of the victim’s rights in criminal procedure" is to explore the current existing Criminal procedure law 97th Article in assessing and analyzing the general principles of victim's rights as well as offering solutions to identified problems.
In the first chapter the author examines the victim’s concept historical development of Latvian SSR Criminal Code and the Latvian Criminal Code in order to understand the origin of the concept and assess the role of the victim at the time required by applicable law. The modern concept of victim in criminal proceedings is studied also, to understand their role and status of this moment in the existing laws. The author also sees several points of concern, for example, that would be necessary to regulate the status of actual victims in criminal proceedings, as well as to focus on issues of private prosecution cases and the status of victims thereat.
The second chapter, the author evaluates the victim's rights general framework, based on the Criminal procedure law 97th Article by analyzing their suitability for modern laws, and offering appropriate solutions to problems. The author concludes that although the current legislation is welcome, it still requires several improvements that would solve many problems in practice.
The author believes that there is no one major problem that could be recognized as the principal in relation to the victim’s rights general principles, but many small, which need a solution to better improve the Criminal procedure law in general. Even greater attention in criminal procedure should be paid to crime victims, because this issue is and will remain topical as shown by the statistics.
Appreciated the fact that victims are increasingly starting to use and understand their rights, thus better protecting their interests.
