Tiesneša atsevišķās domas regulējums civilprocesā

Abstract

Bakalaura darba autore ir Zane Meiersone. Bakalaura darba tēma ir „Tiesneša atsevišķās domas regulējumus civilprocesā.” Darbs sastāv no ievada, trīs daļām, divām apakšnodaļām, kopsavilkuma un izmantotās literatūras, un juridisko aktu saraksta. Bakalaura darba mērķis ir: veikt analīzi par tiesnešu atsevišķās domas regulējuma mērķi, nozīmi un attīstību Latvijas tiesību sistēmā.Uzmanība tiks vērsta uz tiesneša atsevišķās domas kā tiesību normas attīstības vispārējo vēsturi un tās nozīmi Latvijā. Bakalaura darba struktūra ir veidota tā, lai gūtu vispārējo priekšstatu par tiesneša atsevišķās domu regulējumu civilprocesā, akcentējot tiesneša lomu tajā. Darba struktūrā atspoguļotas un izvērtētas tiesību teorijas nostādnes, analizētas publikācijas un demokrātiskas valsts principi, kas sevī iekļauj tiesnešu neatkarību un taisnīgumu. Pētījuma veikšanas procesā tiks apzināti un analizēti gan Latvijas tiesību avoti, gan starptautiskie tiesību akti, kas regulē tiesneša profesionalitātes, ētikas, darbības jomas, kā arī, izmantojot rūpīgu atlasi, pētījumā tiks izmantoti interneta resursi. Pamatojoties uz iegūtajiem izpētes un analīzes rezultātiem, tiks izstrādāti priekšlikumi, risinājumi problēmu jautājumiem, kas saistīti ar tiesneša atsevišķās domas regulējumu civilprocesā. Bakalaura darbā tiks izmantota dažāda veida literatūra (kopā 40 avoti), normatīvie akti (kopā 10) un juridiskās prakses materiāli (kopā 6), darba apjoms ir 46 lpp.

Bachelor thesis author is Zane Meiersone. Bachelor thesis topic is "Regulation of Judge`s Seperate Idea in the Civil Process". The work consists of an introduction, three parts, two sub-sections, and summary of literature and legal instruments to the list. Bachelor's job target is to: conduct an analysis of judges' individual thoughts regulatory objectives, role and development of the Latvian legal system. Attention will be focused on the judge's individual opinion as a law of development of general history and its role in Latvian. Bachelor's work is structured so as to obtain the overall picture of the judge's disentting opinion in the civil procedure rules, emphasizing the judge's role in it. Work structure are reflected in legal theory and evaluated approaches to analysis and publication of democratic principles, which includes judicial independence and fairness. The survey process will be identified and analyzed both the Latvian sources of law, and international laws governing the judge's professionalism, ethics, scope, and through careful selection, the study will make use of Internet resources. Based on the findings of research and analysis, will develop proposals for solutions to problem issues related to the judge's separate opinion in the civil procedure rules.
