Kad cilvēks nomirst rodas jautājums, ko darīt tālāk ar mirušās personas atstāto mantu. Pasaulē pastāv dažādas mantojuma tiesību sistēmas. Latvijas Republikas Civillikums pieturas pie sistēmas, kura pieprasa mantinieka darbību – pozitīvu gribas izteikumu, lai viņš varētu kļūt par mantinieku, un mirušā manta, kā arī visas saistības pārietu uz viņu. Automātiski tas nenotiek. Šo darbību uzskata par mantojuma pieņemšanu, ar kuru mantinieks izdara savu izvēli mantojumu pieņemt. Vēlāk mantojumu atraidīt vairs nav iespējams. Latvijas mantojuma tiesībās pastāv izvēles brīvība attiecībā uz mantojuma pieņemšanu vai atraidīšanu. Mantojuma pieņemšana ir atbildīgs solis, jo, piemēram, mantojums var būt apgrūtināts ar parādiem, par kuriem jāatbild mantiniekiem, kuri pieņēmuši mantojumu vai nu ar visu savu paša mantu, vai tikai mantojuma apmērā.
Pētījums sniedz ieskatu mantojuma pieņemšanas institūta jēdzienā, tā attīstību un būtiskajās iezīmēs, kā arī pašā mantojuma pieņemšanas procedūrā Latvijas tiesību sistēmā. Darbā aplūkoti arī aktuālākie problēmjautājumi, kas saistīti ar mantojuma pieņemšanas regulējumu un sniegti priekšlikumi to risināšanai.
Pētījuma rezultātā autore secina, ka mantojuma pieņemšanas institūtu ir iespējams saskaņot un modernizēt, izdarot attiecīgus grozījumus normatīvajos aktos, kas regulē mantojuma pieņemšanu, piemēram, novēršot pretrunas starp LR Civillikumu un Notariāta likumu, un, nosakot, ka klusēšana nav uzskatāma par mantojuma pieņemšanu. When a person dies the question arises “What to do with the property of the dead people?” In the world there are many inheritance laws. The Inheritance law of Latvia requires an action of successor - declaration of intention to become an heir. This action is the institute of heritage adoption, with whom the heir expresses his first but primary step to adopt the heritage. After adopting the heritage it cannot be renounced. The Inheritance law of Latvia provides a freedom of choice to become the heir; the heritage adoption is responsible step, because the heritage can be encumbered with liabilities and the heir is responsible for all liabilities.
This research gives review of the concept of institute of heritage adoption, its features and how did it develop and evolve. This research also considers topical problems, which are connected with regulation of heritage adoption, and recommendations are given as well.
The author concludes that the institute of heritage adoption can be harmonized and modernized by making changes in the regulation of heritage adoption, for instance, preventing contradictions between Latvian Civil code and Notaries law and by prescribing that the heritage adoption cannot be accepted by silence.
