Ar brīvības atņemšanu notiesāto personu nodarbināšana

Abstract

Bakalaura darba ietvaros autore izvirzīja uzdevumus izzināt sodu izpildi tā pirmsākumos, šodien Latvijā un ārzemēs, liekot lietā normatīvo aktu regulējumu, prakses materiālus un statistikas datus. Izvirzot konkrētos uzdevumus, bija svarīgi saprast kopējo situāciju un problēmas notiesāto nodarbināšanā un apzināt iespējamos risinājumus. Latvijas prakse ar brīvības atņemšanu notiesāto nodarbināšanā ar katru gadu uzlabojas, taču, lai kā likumi tiktu uzlaboti, starp cietumā un brīvībā strādājošajiem pastāv atšķirības, kas atklājas arī sabiedrības uzskatos. Neņemot vērā darba sliktos apstākļus (atšķirībā no brīvībā esošajiem), ir apsveicami, ka notiesātie strādā un stāv rindās uz darba vietām. Tāpat pēdējo desmit gadu laikā Satversmes tiesas darbības lokā nonāk notiesāto sūdzības, kas apstrīd nacionālās likuma normas un arī panāk to grozījumus.

In this Bachelor thesis the author puts forward the task to explore the early days of execution of punishments, today in Latvia and abroad, using legislative regulations, internship materials and available statistics. While setting out specific tasks, it was important to understand the overall situation and problems in the employment of convicts, and to identify possible solutions. The practice in the Republic of Latvia regards to employment of imprisioned persons is improving every year, however, despite the improvements in legislative regulations, there are still quite significant discrepancies between the employment of imprisoned and free persons. These differences are also revealed in opinion of society. Considering the poor working conditions of imprisoned persons (as opposed to the free persons), it is good that imprisoned persons are working and queuing for jobs. In addition, over the last decade Constitutional Court of the Republic of Latvia has received a number of complaints from imprisoned persons, which challenge the national legislative norms, and manage to amend them.
