Lai garantētu personu tiesību un tiesiski aizsargāto interešu respektēšanu un labprātīgu savu pienākumu izpildi valsts vara tiesību pārkāpējam piemēro juridisko atbildību. Tā kā kriminālatbildība rada visnopietnākās negatīvās sekas personai, tad autors uzskata par nepieciešamu noteikt skaidrus tās un administratīvās atbildības nošķiršanas kritērijus, ņemot vērā arī to, ka pēdējās regulējumu tuvākajā nākotnē sagaida būtiskas izmaiņas.
Pētot normatīvos tiesību aktus, tiesību zinātnieku viedokļus un tiesu prakses materiālus, pielietojot salīdzinošo un vēsturisko metodi, autors secina, ka būtiskākais nošķiršanas kritērijs ir pārkāpuma sabiedriskā bīstamība, kas administratīvajam pārkapumam ir zemāka nekā noziedzīgam nodarījumam. Pie administratīvās atbildības drīkstētu saukt tikai valsts pārvaldes iestādes. Administratīvo atbildību drīkstētu paredzēt tikai par pārkāpumiem, kas apdraud valsts pārvaldes kārtību. Offenders are called to justice by state authority in order to ensure reverence of the rights and legitimate interests of the members of society and execution of one’s duties voluntarily. Taking into account that criminal liability is the one, which invokes the most serious negative consequences to the person, the author reckons that it is quite important to determine obvious criteria for distinguishing administrative and criminal liabilities. It is particularly relevant now, when legislation on the administrative liability is challenging significant changes.
After the research of the legislation, doctrine and the case law, applying comparative and historical methods, the author has concluded that as the most essential criterion for the separation of administrative and criminal liabilities appears the public danger of the offence – it is lower in the case of administrative offences, but higher in the case of criminal offences. Institutions of state administration should be exlusively entitled to have jurisdiction over the administrative offences. Administrative liability should be provided exclusively for the offences in the sphere of the order of state administration.
