Darba temats saistīts ar pārraidītās informācijas noslēpuma aizsardzību. Par informācijas noslēpumu uzskatot jebkuru informāciju, kura tiek nodota starp divām vai vairākām personām, izmantojot korespondenci, telekomunikācijas, vai citu informācijas pārraidīšanas veidu, un personas nav izteikušas vēlmi šo informāciju publiskot vai nodot trešajām personām. Krimināllikuma 144.pants aizliedz tādas darbības, kas saistītas ar šādas informācijas pretlikumīgu iegūšanu un izpaušanu trešajām personām, tā radot kaitējumu personas tiesībām uz privāto dzīvi. Darba mērķis ir radīt plašāku izpratni par korespondences un pa citurieni pārraidītās informācijas noslēpuma pārkāpšanu. Lai mērķi sasniegtu, darbā tiek pētīta panta attīstība vēstures gaitā, tā saturs un piemērošanas prakse mūsdienās, kā arī tiek veikta panta salīdzināšana ar citu valstu krimināllikumiem.
Veicot darbu autore ir izdarījusi secinājumus, ka panta piemērošanas prakse pagaidām ir visai neliela, bet tajā regulētais nodarījums likumpārkāpēju vidū kļūst aizvien aktuālāks un tehnoloģijas ar kuru palīdzību tās tiek veiktas, attīstās līdzi laikmetam, tādēļ ir vajadzīga ne vien normatīvo aktu sakārtošana šajā jautājuma, bet arī pašu cilvēku rūpīgāka attieksme pret informācijas, kura satur personīgas ziņas, izpaušanu un nodošanu citām personām. The subject of this assignment is related to the protection of information secret that has been transmitted. Information secret being considered as any information that has been passed on between two or more people using correspondence, telecommunications or any other way of transmitting information, and people involved haven’t indicated that they want this information to be published or passed on to the third parties. Section 144th of the Criminal Law prohibits actions that are related to illegal acquisition of such information and disclosure of it to the third parties therefore harming person’s right to privacy.
The objective of this assignment is to create a wider perception on how information secrets are breached through correspondence and any other way of transmission.
To achieve this, the work explores the development of the Law Section over the years, the content and application of practise nowadays as well as comparing this Section to the Criminal Law in other countries.
Doing this assignment the author has made conclusions that the application of the Section in practise is still quite small but the offense that it regulates is becoming more and more topical among offenders and the technologies used keep evolving as well. Therefore a change in the normative acts regarding this matter is needed and people should choose more carefully regarding passing on private information and secrets to other persons.
