Abstract

Šī bakalaura darba mērķis bija izpētīt Satversmes 77. panta saturu un tā mijiedarbību ar citiem Satversmes pantiem. Kā arī noskaidrot, kāds ir šī panta mērķis un nozīme Satversmē, ko tas tieši aizsargā un kādā veidā tas tiek darīts. Darba rezultātā tika noskaidrota Satversmes 77. panta attīstība, līdz pašreizējam regulējumam. Kā arī izpētīti 1998. gada grozījumi, kuru rezultātā Satversmes 77. pants tika papildināts ar vēl diviem pantiem. Tika skatīts, vai šādi grozījumi bija nepieciešami un tiesiski. Satversmes 77. pants nosaka, ja Saeima grozījusi Satversmes pirmo, otro, trešo, ceturto, sesto vai septiņdesmit septīto pantu, tad šādi pārgrozījumi nododami tautas nobalsošanai. Darba gaitā tika noskaidrots, ka Satversmes 77. pantu var grozīt kā ar tiešiem tekstuāliem grozījumiem, tā ar citiem tiesību aktiem. Kā arī darba gaitā tika noskaidrots, ka Satversmes 77. pants aizsargā saturu nevis tekstu. Tātad pēc būtības izdarot tekstuālus grozījumus, kas nemaina konstitucionālā panta saturu, nebūtu jārīko tautas nobalsošana. Tiek skatīta kārtība, kādā iesniedzami likumprojekti un Satversmes grozījumu projekti to trūkumi un iespējamie risinājumi. Darba gaitā tiek vērtēta Satversmes 77. un citu Satversmes pantu mijiedarbība, kā arī noskaidrots, ka lai grozītu konstitucionālo pamatu, nav nepieciešama Saeimas piekrišana, pietiek tikai ar tautas izteiktu gribu referendumā. Satversmes 77. pants paredz tautas „gala vārdu” konstitucionāli svarīgu jautājumu izlemšanā, kas izriet no Satversmes 2. panta, kurš nosaka, ka suverēnās varas nesēja valstī ir tauta. The purpose of this work was to analyze the 77th article of the Constitution and its correlation with other articles, as well as to find out what the objective and meaning of this article in the Constitution is, what it protects and how exactly it is done. As a result of the work the development of the 77th article up to the current framework in the Constitution was defined. The amendments to the Constitution of 1998, as a result two other paragraphs were added to the 77th article, were analyzed. It was examined if these amendments were necessary and legal. The 77th article of the Constitution states if the Saeima amends the first, second, third, fourth, sixth or seventy-seventh article, such amendments should be submitted to a referendum. It was found out that the 77th Article of the Constitution can be amended with direct textual changes and with other legal acts, as well as that 77th Article protects content rather than text. So if textual amendments do not change the substance of the constitutional article, there is no need to hold a referendum. The procedures for amendments as such, as well as amendments to the Constitution, the problems and possible solutions were analyzed. The correlation between 77th Article and other Constitutional Articles was evaluated and it was found out that constitutional framework amendments do not require parliamentary approval; it is enough with the express of the people will in a referendum. The 77th Article of the Constitution provides for nation "final word" for constitutionally significant decisions arising from the 2nd Article of the Constitution, which states that the sovereign power of the state belongs to the nation.
